Personal Rights. The licensee shall ensure that each child is accorded the following personal rights:To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not being met as evidence by: Interviews conducted stated that there has been a time(s) when their child has come home with a soiled diaper resulting from child not being changed in a timely manner. This poses a potential risk to the health and safety to the children in care.

Personal Rights. The licensee shall ensure that each child is accorded the following personal rights: to be accorded dignity in his/her personal relationships with staff and other persons. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; ... physical functioning. This requirement was not met as evidenced by interview: A staff member was speaking in an inappropriate way to a child in care. CCL regulations state that children have personal rights, and those rights include to be treated with dignity in his/her personal relationship with staff and other persons, and to be free of mental abuse. This poses an immediate health risk to the Personal Rights of children in care.

Section 101229 (a)(1) that no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time, except as specified in sections 101216.2 (e)(1) and 101230 (c)(1). Based on the Staff Interview, a child was left unattended after the class transitioned from the outdoor play area to their classroom on 7/7/23 at around 4:15 to 4:35 pm which was an immediate risk to the health and safety and personal rights of children in care.
