What the inspector wrote

On Tuesday, August 8, 2023, at 9:50 am, Licensing Program Analysts (LPAs) Manel Estoesta and Jaleesa Jackson conducted a Case Management - Incident Visit. LPA met with the Director Lori Reeser and Assistant Director Tarie Lang and explained the nature of the visit. Present on this visit were 11 Staff and 51 preschool children. The facility operates from Monday to Friday 7am to 6 pm. On Monday, July 10, 2023, around 10 am, the Director reported an Unusual Incident to the Oakland Southeast Regional Child Care Office via phone. The Unusual Incident was about a child was found by staff at the outdoor play area without a supervision of a teacher on 7/6/23 at around 4:35 pm. A completed LIC 624 Unusual Incident Report was faxed on 7/12/23 at 2:21 pm. LPA conducted staff interview, a health and safety inspection with the Director, record review and obtained copies of the Staff and children's sign in and out sheets and rosters, LIC 500, a copy of the CRC dated 7/6/2023 and facility's correspondence. Based on the Staff Interview, a child was left unattended after the class transitioned from the outdoor play area to their classroom on 7/6/23 at around 4:15 to 4:35 pm. A teacher learned that the child was missing when the teacher conducted a census at the hallway to their classroom. Another teacher went back through a classroom out to the outdoor play area and found the child "hiding" next to the outdoor play area storage and brought back the child to their classroom. The teachers did not notify the facility's person in charge that day and or the Director about the incident. The Director received an email the next day from another teacher who witnessed the incident. The Director conducted an internal investigation and Staff Meeting. The authorized representatives of the child were notified about incident by the Director. The facility is in violation of Section 101229 (a)(1) that no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time, except as specified in sections 101216.2 (e)(1) and 101230 (c)(1). See LIC 809 C. LPA Estoesta informed the Director and that this report dated 08/08/2023 included a Type A Citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Estoesta informed the Director to provide a copy of this licensing report dated 8/8/2023 that document of any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Director Lori Reeser and Director Terie Lang.
