(6) The toddler program shall be conducted in areas separate from those used by older or younger children... This requirement is not met as evidenced by: Based on observation, interviews, and record review, the licensee did not comply with the section cited above by commingling C1, C2, and C3 between preschool and toddlers class which poses a potential health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

Responsibility for Providing Care and Supervision for Infants: (a) In addition to Section 101229, the following shall apply: (2) Sleeping infant(s) shall be directly observed... (B) Staff shall physically check on sleeping infant(s) every 15 minutes and document...This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by not consistently logging 15-minute sleep checks for infants under the age of 2 years old, which poses a potential health, safety or personal rights risk to persons in care.

Infant Care Food Service: (j) Bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date.This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by not labeling children's foods that are stored in the refrigerator, which poses a potential health, safety or personal rights risk to persons in care

101223(a)(7) Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (7) Not to be placed in any restraining device. Postural supports may be used as specified in Section 101223.1.This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by putting children in chairs and using seat belt buckles/restraints on children which poses a immediate health, safety or personal rights risk to persons in care.

Based on observation record review, the licensee did not comply with the section cited above by not having the infants needs and services signed by the centers representative which poses/posed a potential health, safety or personal rights risk to persons in care.

OUTDOOR ACTIVITY SPACE

Based on observation, the licensee did not comply with the section cited above by not ensuring that the outside playground area is maintained, clean, and in good condition for children to play freely which poses/posed a potential health, safety or personal rights risk to persons in care.

FOOD SERVICE

Food Services. Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative.This requirement is not met as evidenced by: Based on interview and record review, facility did not offer the morning snack that was listed on the menu, which poses a potential health and safety risk to children.

Infant Care Teacher Qualifications and Duties. Completion, with passing grades, of 12 postsecondary semester or equivalent quarter units in early childhood or child development education at an accredited or approved college or university.This requirement is not met as evidenced by: Based on observation and record review, LPA observed upon entrance to the facility that there was two staff and 10 toddlers. Both staff do not have any completed units, which poses an immediate health and safety risk to children in care.

Child day care centers serving infants; optional toddler program; departmental guidelines and regulations. A ratio of six children to each teacher shall be maintained for all children in attendance at the toddler program.This requirement is not met as evidenced by: Based on observation and record reviews, LPA observed that S-1 and S-2 were with 10 toddlers. S-1 and S-2 do not have any completed units, which poses an immediate health and safety risk to children in care.

Parents shall give permission for the placement of their children in the toddler program.This requirement is not met as evidenced by: Based on record review, 6 out of 8 children did not have written permission from parent to place child in the toddler program, which poses a potential health and safety risk to children in care.

The maximum group size, with two teachers, or one fully qualified teacher and one aide, shall not exceed 12 toddlers.This requirement is not met as evidenced by: Based on observation, LPA observed on 10/19/2023 that there were three staff with 13 toddlers, which poses a potential health and safety risk to children in care.

CRIMINAL RECORD CLEARANCE

All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f)...This requirement is not met as evident by: Based on record reviews, S-1 and S-1 have fingerprint clearances and are associated to preschool license, which poses a potential health and safety risk to children in care.
