    (1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights...(2) Upon enrollment of a new child in a facility, the licensee shall provide to the parents or legal guardians of the newly enrolling child copies of any licensing report that the licensee has received during the prior 12-month period that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care...This requirement was not met as evidence by: Based on observation and record review the licensee did not comply with the section cited above by not having all parents sign the LIC 9224 when the Type A citation happened (OCT 2023) and when they have newly enrolled students into this facility which poses a potential health, safety or personal rights risk to persons in care.

    (3) The licensee shall require each recipient of the licensing report described in paragraph (1) pertaining to a complaint investigation to sign a statement indicating that he or she has received the document and the date it was received.(4) The licensee shall keep verification of receipt in each child's file.     Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs This requirement was not met as evidenced by: a staff caused injury to an infant child while trying to get the infant child to sleep during nap time on July 17, 2023. The Facility terminated the staff person as a result of the incident. This presents an immediate risk to the health, safety, or personal rights of children in care.

This requirement was not met as evidenced by: Based on time sheets, teacher qualifications and sign in/out sheets for children, the facility was out of ratio. It was noted that Hutaf Kafeety and Shyla Duarte are not qualified infant teachers as they have not completed three semester unit in the care of infants and were left alone with four infants on 02/16/2021 and one infant on 02/17/2021 during the morning hours. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
