What the inspector wrote

Licensing Program Analysts (LPAs) Jennifer "Jen" Beehler and Marilou Monico conducted an unannounced complaint investigation and met with Danna Osborn, Site Director. Purpose of today's inspection was explained to Director Osborn. LPAs toured the exterior part of the facility and observed and measured the gate that encloses the playground area. The fence surrounding the playground was over four feet, however the gate was shorter than 4 feet. Based on the available evidence, the preponderance of evidence standard has been met, therefore the above allegation is SUBSTANTIATED. California Code of Regulations (Title 22, Division 12) are being cited on attached LIC9099-D.

    OUTDOOR ACTIVITY SPACE

    Outdoor Activity Space: The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence shall be at least four feet high.This requirement was not met as evidence by; LPAs observed the fence surrounding the playground was over 4 feet, however the gate was shorter than 4 feet. This posses a potential risk to the health, safety and personal rights of children in care.

    BUILDINGS AND GROUNDS

    Buildings and Grounds: All licensees shall ensure the inaccessibility of pools, including swimming pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds or similar bodies of water, through a pool cover or by surrounding the pool with a fence. The above requirement was not met as evidence by: LPAs observed standing water in the water table, two buckets filled with water on the other side of at least a 2ft fence. This posses a potential risk to the health, safety and personal rights of children in care.
