What the inspector wrote

On 12/3/21 Theresa Russo and the LPA reviewed 14 files and were unable to locate the signed documentation ‘Acknowledgment of Receipt of Licensing Reports’ (LIC 9224) in seven as follows: Four (C1, C11, C12, C14) of the 14 files checked were missing any documentation. Three of the signed forms (C2, C3, C13) indicated that the type A violations were posted or could be found online instead of providing a copy as required. On 12/3/21 Office staff, Theresa Russo confirmed said that in some cases they tell the parents where to find the reports online instead of providing a copy. Five parents were interviewed and one confirmed that they never received copies of the Type A reports and were not aware of the previous violations that affect the health and safety of children in care therefore the allegation is substantiated. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days.

    Health and Safety Code Section 1596.8595 (c) A licensed child care facility or home shall provide to the parents of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as specified in paragraph (1) of subdivision (a) of Section 1596.893b. This requirement is not met as evidenced by: missing documentation for C1, C2, C3, C11, C12, C13 & C14 as based on file review and interviews the facility failed to provide copies of type A violations to Children's representatives. Which poses/posed a potential Health and Safety risk to children in care.
