PERSONNEL REQUIREMENTS

Based on record review the licensee did not comply with the section cited above, Staff S3 does not have a LIC 503, Tb test or immunization on file which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above, Staff S4 does not have a current mandated reporter training which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

INFANT CARE CENTER SLEEPING EQUIPMENT

Cribs shall be free from all loose articles and objects, including blankets and pillows.Based on LPA's observation, one infant was allowed to sleep in a crib with a bottle. This is a potential health and safety risk to children.

7 sleep logs were observed to be missing initials or signatures, signing off the Safe Sleep15-minute checks had been completed.

Health and Safety Code Section 1596.8595 (c) A licensed child care facility or home shall provide to the parents of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as specified in paragraph (1) of subdivision (a) of Section 1596.893b. This requirement is not met as evidenced by: missing documentation for C1, C2, C3, C11, C12, C13 & C14 as based on file review and interviews the facility failed to provide copies of type A violations to Children's representatives. Which poses/posed a potential Health and Safety risk to children in care.

An aide assisting a fully qualified teacher shall meet the following requirements:Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development. (or enrollment) Based on interviews and record reviews, the licensee did not comply with the section cited above in 2 out of 7 staff (S2&3) which poses a possible health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS Staff shall physically check on sleeping infants every 15 minutes. Documentation shall be maintained in the infant’s file and be available to the Department for review. Not met as evedneced by staff admission and LPA observation; no documentation avaiable for the 11 infants in care on 6/29/21. This poses a potential risk to the health and safety of infants in care.

Infant Care Personal Services: The infant care center shall ensure that the infant has sufficient changes of clothing and diapers so that his/her clothing and diapers can be clean and dry at all time & each infant's clothing and diapers shall be changed as often as necessary to ensure that the infant is clean and dry at all times. Was not met based on witness statements, children not being clean and dry at pickup and an increase in rashes. Based on parent and staff interviews. Which posed a potential Health and Safety risk to children in care.

Infant Care Food Service:High chairs or other appropriate seating equipment shall be used to seat infants during feeding. Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding. Was not met as evidenced by: C-1 was placed in a small wooden chair when she was unable to hold herself up and fell and hit her head on the tile floor and was placed back in the same chair. Based on internal incident report and witness interviews. Which posed a Health and Safety risk to children in care.

Reporting Requirements Events reported shall include any unusual incident or child absence that threatens the physical or emotional health or safety of any child & shall also be reported to the child's authorized representative.
