What the inspector wrote

On 2/11/22 at 2 PM Licensing program analyst (LPA) Snow conducted a facility inspection to deliver complaint findings. It was alleged that Licensee did not report an outbreak of RSV as required. On 10/8/21 at 11:45am staff, Karen and Theresa denied the allegations explaining that 2 infants had tested positive for Raspatory Syncytial Virus (RSV) on 9/16/21 and the facility had required a negative test or quarantine for all the infants in attendance. On 2/8/22 at 2pm, Licensee, Susan Wilson denied the allegation confirming the first case was on 9/16/21 and they immediately posted the information. The following day on 9/17/21 they checked children for symptoms upon arrival but later in the day several infants showed symptoms, so they closed and required a note from the doctor or quarantine before children returned. The facility provided a copy of the Incident report, a copy of the attendance for the week of 9/16/21 and staff phone numbers and a copy of the exposure notification that was posted. 2 staff & 7 parents were interviewed and all, but one denied by saying they were informed; one witness said she did not observe the posted sign and she does not recall being notified until the closure. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.

    Health and Safety Code Section 1596.8595 (c) A licensed child care facility or home shall provide to the parents of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as specified in paragraph (1) of subdivision (a) of Section 1596.893b. This requirement is not met as evidenced by: missing documentation for C1, C2, C3, C11, C12, C13 & C14 as based on file review and interviews the facility failed to provide copies of type A violations to Children's representatives. Which poses/posed a potential Health and Safety risk to children in care.
