What the inspector wrote

(Continued from LIC 9099) Interview conducted by Staff (S1 & S2) confirmed the incident when a rodent fell from ceiling tile after being caught in a trap and that rodent feces have been observed at the facility which corroborated CD & AD’s statement. Children’s interviews did not any current concerns with the allegation at this time. Based on the information gathered during this investigation, the preponderance of the evidence standard has been met. Therefore, the allegation is determined to be substantiated. California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. Appeal rights were provided. An exit interview was conducted, and this report was read and discussed with the facility’s Director, Erika Silva (CD). The Notice of Site Visit shall be posted for 30 days.

    (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement is not met as evidenced by: Based on interviews from CD, AD & Staff, an incident occurred when a rodent fell from a ceiling tile after being caught in a trap with no daycare children present, which poses a potential health, safety or personal rights risk to persons in care.

    102416.2(b) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.... written report ... shall be submitted to the Department within seven days following the occurrence of such event." This requirement is not met as evidenced by: Based on an interviews, Direcor did not notify and submit a UIR to CCL. This posed a potential health, safety and/or personal rights risk to children in care.
