This requirement is not met as evidenced by: Based on LPA observations of cots being too close together, AD & S9 interview, S1 sets cots out while children are outside playing before lunch and S3 & S4 stated they set cots up before children go outside which poses a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidenced by: Based on AD, S2, S8-S9 interviews, 2 staff handled 2 different children in a rough manner which poses a potential health, safety or personal rights risk to persons in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 (a)(1) The licensee shall provide care and supervision as necessary to meet the children’s needs. No child(ren) shall be left without the supervision of a teacher at any time.... Supervision shall include visual observation.This requirement is not met as evidenced by: Based on the facility's self reported UIR, S2-S3 interviews, S2, S3 & S5 written statements and documents received a child was left without supervision in the facility hallway during a transition from one preschool classroom to another for approximately 1-5 minutes. This poses an immediate health and safety risk to children in care.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    Fixtures, Furniture, Equipment and Supplies(e) Faucets used by children for personal care shall deliver hot water.(4) All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities. This requirement is not met as evidenced by: Based on interviews and observations from CD & LPAs, feces was not cleaned or sanatized from a toilet seat from 12/3/25 to 12/8/25, which poses a potential health, safety or personal rights risk to persons in care.

  • BUILDINGS AND GROUNDS

    (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement is not met as evidenced by: Based on interviews from CD, AD & Staff, an incident occurred when a rodent fell from a ceiling tile after being caught in a trap with no daycare children present, which poses a potential health, safety or personal rights risk to persons in care.

    102416.2(b) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.... written report ... shall be submitted to the Department within seven days following the occurrence of such event." This requirement has not been met as evidenced by: On 10/25/2024, C1 left the premises for roughly 1-2 minutes resulting in an absence of supervision, which poses an immediate Health and Safety risk to children in care.

    Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on the Unusual Incident Report submitted by the facility on 5/17/2023, reporting that Child 1 was without supervision of a teacher in the outside playground for at least 8 minutes. This poses an immediate health and safety risk to the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: On UIR of 07/12/2022, S2 and S3 did not observe that C1 wondered away from the playground and attempted to run inside the classroom. This presents a potential threat to the health and safety of children in care.

  • REPORTING REQUIREMENTS

    (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.(1) Events reported shall include the following:(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. UIR occurred on 07/12/2022 and UIR was received to CCL on 08/03/2022. This poses a potential safety to the children in care,

  • ARTICLE 2. Administration of Child Day Care Licensing

    On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by: Based on staff records reviewed which revealed five out of eleven staff records were missing the AB 1207 Mandated Reporter Training certificate as required by H&SC 1596.8662(b)(1).

  • 101212(b)(1)(A)Type B

    Whenever a change in child care center director is reported, in addition to his/her name, the report shall include the following: Verification of the completion of the course work required in Section 101215.1(h). A photocopy of a college transcript, or a photocopy of a Child Development Site Supervisor Permit or a Child Development program Director Permit, shall meet this requirement.This requirement is not met as evidenced by: based on CD not submitting her verification of Director’s qualification to the Department within 10 days, as required by CCR 101212(b)(1)(A). This posed a potential health and safety risk to the children in care.

  • 101216.2(d)(1)Type A

    An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children, pursuant to Section 101216.3 shall meet the following requirements: Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development. This requirement is not met as evidenced by: Based on the Aide in the Pre-K class did not meet the Teacher Aide qualifications of Title 22 regulations, 101216.2 which allows 18 children to be in care with a fully qualified Teacher and a Teacher’s Aide. This poses an immediate health and safety risk to the children in care.

  • 101216.3(b)(1)Type A

    A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d).This requirement is not met as evidenced by: Based on multiple statements that corroborated that the Pre-K and other classrooms operating out of ratio on multiple occasions for several weeks. This posed a posed an immediate health and safety risk to the children in care.

  • 101216(g)(1).Type B

    Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure.This requirement is not met as evidenced by: based on staff records reviewed which reveald that two staff did not have proof of negative TB as mandated by California Code of Regulations (CCR) 101216(g)(1). This poses a potential health and safety risk to the children in care.
