Inspector’s narrative

What the inspector wrote

An inspection was conducted at the facility by Licensing Program Analysts, Sebastian Phouthavong. LPA met with Director, Erika Silva. During the inspection the home was toured inside and outside. From an interview conducted with Director, an incident occurred last week, when a rodent fell from a ceiling tile after being caught in a trap. Director further stated that no daycare children were present when the incident occurred and staff immediately resolved the issue by removing the rodent from the facility. The facility did not notify Community Care Licensing (CCL) and a written Unusual Incident Report was not submitted within 7 days of the incident occurring as required. LPA did received a written Unusual Incident Report during today's visit. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement is not met as evidenced by: Based on interviews from CD, AD & Staff, an incident occurred when a rodent fell from a ceiling tile after being caught in a trap with no daycare children present, which poses a potential health, safety or personal rights risk to persons in care.

102416.2(b) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours.... written report ... shall be submitted to the Department within seven days following the occurrence of such event." This requirement is not met as evidenced by: Based on an interviews, Direcor did not notify and submit a UIR to CCL. This posed a potential health, safety and/or personal rights risk to children in care.
