What the inspector wrote

There were six children and one staff member present at the facility in addition to the licensee. The licensee denied all allegations. The licensee stated that daycare children are never left unattended at the facility and are always supervised by at least one qualified adult. The licensee stated that she currently employs one assistant (staff S2) who supervises the children in her absence. The licensee stated that on the day of the alleged incident, she was present at the facility with S2 when A1 arrived at the facility to pick up C1. The licensee stated that due to state and local COVID guideline\342\200\231s, all pick-ups and drop-offs are conducted at the facility\342\200\231s main daycare entrance rather than inside the facility. The licensee stated that she met with A1 on the day of the alleged incident. The licensee stated that she notified A1 that C1 did not attend that day. The licensee stated that A1 left the premises upon learning of this. The licensee stated that A1 did not ask to enter or inspect the facility. The licensee stated that she has never denied entry to an authorized representative. The licensee stated that she has never retaliated against a childcare client. The licensee acknowledged that she did terminate C1\342\200\231s childcare contract but did so according to her facility\342\200\231s admission agreement which states the provider may terminate the contract for any reason that is deemed by the provider to be detrimental to the care, safety, or health of the child/others. The licensee stated that she was following the terms of her contract. The licensee\342\200\231s assistant was interviewed during the investigation. Staff member S2 was interviewed on 06/07/21 at 09:52am. Staff S2 stated that she has never observed any children left unattended at the facility. S2 stated that there is always at least one qualified adult at the facility supervising the children. S2 stated that she has never observed any client or authorized representative being denied entry into the facility. Staff S2 corroborated the licensee\342\200\231s statements. During the complaint investigation, interviews were also conducted with clients and day care children. Clients interviewed all stated that they have never observed any children being left unattended at the facility. Clients all stated that they felt welcomed by the licensee and have never been denied entry into the facility. The children interviewed during the investigation all stated that they are never left unattended at the facility and are always supervised by at least one adult. Based on available information and interviews conducted with children, clients, staff and the licensee, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are unsubstantiated. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with the facility licensee. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided. This report was emailed to the licensee.
