What the inspector wrote

L1 denied the allegation, stating that there is a musty smell when you open the cupboard in the bathroom in the infants room, but no mold. L1 stated that there was a leak in the toilet, so they had to pull the sink out because they could not find the pipe for the toilet. L1 stated that her husband hired a person to do the work, and does not have an invoice at this time, but stated that there was never any mention of mold from the person who did the work. One staff interviewed, stated that the sink in the infant bathroom was replaced over the weekend of 10/25 - 10/26; stating that during the week prior, the wall where the old sink was located was exposed. The staff reported observing the wall to be black and spotty. The staff did not have information about who did the work. The staff stated that the bathroom was blocked off with a child safety gate, so the children did not have access. The other staff corroborated the first staff’s statement about observing the mold, but the date of the repair varied, stating that the wall was exposed the last week of September. Parents (A1-A6) did not have any information about mold being present in the facility and reported that they never smelled a musty odor in the classroom. During today's visit, L1 provided an invoice of work completed in the infant bathroom beginning 10/11/25, stating that sheet rock was removed, given 72 hours to dry and replaced with new sheet rock. Nothing about mold was included in the invoice. Based on evidence collected during the complaint investigation there is not a preponderance of evidence that a violation has occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that an alleged violation occurred, therefore the allegation is UNSUBSTANTIATED. Staff interviewed stated that during the week of 10/27/25 the thermostat in the preschool room read 64 degrees, and although they tried to turn it up to 80 degrees, an hour later it was still reading 64 degrees. Staff reported that they informed L1 that the heater was not working on 10/29/25 and L1 brought in a space heater. Staff stated that they did not use the space heater because they didn’t believe it was safe to use around the children. During interview on 10/31/25, staff stated that it was currently 73 degrees in the infant room and 66 degrees in the preschool room. A staff interviewed on 11/06/25 stated that L1 never showed them how to use the thermostat and when they tried to turn the heater in the preschool room up, it did not get warmer. Three of the six parents interviewed reported that the classroom was cold but did not give a temperature in degrees. During a tour of the facility on 11/05/25, LPA observed the thermostat to read 67 degrees. LPA Strother observed Monika switch the thermostat to "on", saw that it was set to 62 degrees and watched as Monika pushed the up-triangle arrow until it was set to 69 degrees. LPAs returned to the room a little later, observing that the thermostat now read 70 degrees. The heater was observed to operate and provide heat but did not appear to be set to maintain the required temperature. During today's visit, LPA Strother toured the preschool room at 10:24am, observing the thermostat to read a current temperature of 66 degrees and was set at 66 degrees. LPA took a photo of the thermostat for record. Based on LPA’s observations, records reviewed and interviews conducted, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22 is cited on the attached LIC9099-D. This report was reviewed and discussed with Licensee, Monika Verma. Appeal Rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.

  • BUILDINGS AND GROUNDS

    (a)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1)The licensee shall take measures to keep the center free of flies, other insects, and rodents.This requirement is not met as evidenced by: Based on interviews, observations and records received the facility had dead cockroaches present on 09/08/25, 11/04/25 and 11/05/25 and the licensee did not ensure that they were cleaned up before or while children were present, which poses a potential health, safety or personal rights risk to persons in care.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    (a) A comfortable temperature for children shall be maintained at all times. (1)The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C).This requirement is not met as evidenced by: Based on interviews, observations and records reviewed, the temperature in the classrooms felt cold and the preschool classroom was below 68 degrees on 11/05/25 and an unknown date, based on photographs of the thermostat, and today 1/23/26, which poses a potential health, safety or personal rights risk to persons in care.

  • PERSONAL RIGHTS

    (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: Based on interview 3 out of 6 parents reported their child having a full diaper at the time of pick up, which poses a potential health, safety or personal rights risk to persons in care.

    (c) The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations: (3) Absence of supervision, including, but not limited to, a child left unattended...This requirement is not met as evidenced by: Based on interviews with S1 and A7, infant C1 left the preschool yard without staff supervision on an unknown date in November 2025, entering the neighbor’s yard, where the neighbor and their dog were present, which poses an immediate health, safety or personal rights risk to persons in care.

  • REPORTING REQUIREMENTS

    (d)Upon the occurrence, during the operation of the child care center…a report shall be made to the Department by telephone or fax within the Department's next working day… In addition, a written report…shall be submitted to the Department within seven days…(1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement is not met as evidenced by: Based on interviews, licensee did not report child’s absence to the Department and did not submit a written incident report, which poses a potential health, safety or personal rights risk to persons in care.

    Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.This requirement is not met as evidenced by: Based on record review the facility roster was incomplete upon request, which poses a potential health, safety or personal rights risk to persons in care.
