    (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: Based on interview 3 out of 6 parents reported their child having a full diaper at the time of pick up, which poses a potential health, safety or personal rights risk to persons in care.

    (a) A comfortable temperature for children shall be maintained at all times. (1)The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C).This requirement is not met as evidenced by: Based on interviews, observations and records reviewed, the temperature in the classrooms felt cold and the preschool classroom was below 68 degrees on 11/05/25 and an unknown date, based on photographs of the thermostat, and today 1/23/26, which poses a potential health, safety or personal rights risk to persons in care.

    Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.This requirement is not met as evidenced by: Based on record review the facility roster was incomplete upon request, which poses a potential health, safety or personal rights risk to persons in care.

  • BUILDINGS AND GROUNDS

    (a)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1)The licensee shall take measures to keep the center free of flies, other insects, and rodents.This requirement is not met as evidenced by: Based on interviews, observations and records received the facility had dead cockroaches present on 09/08/25, 11/04/25 and 11/05/25 and the licensee did not ensure that they were cleaned up before or while children were present, which poses a potential health, safety or personal rights risk to persons in care.

    (d)Upon the occurrence, during the operation of the child care center…a report shall be made to the Department by telephone or fax within the Department's next working day… In addition, a written report…shall be submitted to the Department within seven days…(1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement is not met as evidenced by: Based on interviews, licensee did not report child’s absence to the Department and did not submit a written incident report, which poses a potential health, safety or personal rights risk to persons in care.

    (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department.This requirement ws not met as evidenced by: Based on interview and record review, two staff S1 and S2 were working with children at the facility without an associated criminal record clearance, which poses an immediate health & safety and personal rights risk to the children in care.
