What the inspector wrote

PAGE 2 One staff (S1) reported a concern about supervision, stating that on or around 11/12/25, they were not certain of the date, L1 had one infant in her care, while they had two preschool age children in their care. S1 stated that infant (C1) entered into the neighbor’s yard through a loose fence board on the preschool yard and was returned by the neighbor to L1 at the fence. S1 reported that the neighbor (A7) was in her backyard with their dog at the time of the incident. Three out of the six parents interviewed shared that they had experienced their child having a full diaper at pick-up time. One parent stated that on 11/03/25 they picked their child up at 12:30pm because L1 requested early pick up due to the child being fussy. At pick up the parent recalled that their child was the only child awake in the play area, with two staff present. The parent reported that when they got to the car, they saw that their child had a poopy diaper. The parent reported that they had to give their child a bath when we got home due to the messy diaper, stating that the child’s skin was raw. Two other parents interviewed stated that they could think of at least one time that their child had a full diaper at pick up. One parent reported that the staff person did offer to change the infant’s diaper, but it was a new staff person that the parent and child were not familiar with so the parent declined, stating they would change the child themselves, because the infant appeared uncomfortable. Of the six parents interviewed, only one parent reported concerns about supervision. The parent reported that on 11/03/25 or 11/04/25 they had to come pick their infant up early observing L1 in the kitchen and an “older lady” in the infant room holding a baby, and two infants in the office area that is next to the infant room without supervision. The parent reported that they said to L1, “Did you know you have little people in the office?” and L1 responded, “Oh no”, and then went into the office to get the infants. Based on the S1’s report of infant C1 entering neighbor A7’s backyard, LPAs Strother and Gaumann conducted an interview with A7 on 01/23/26 at 9:30am. A7 reported that on a sunny day in November, sometime before Thanksgiving, she was in her backyard with her dog, a Shih Tzu, when she looked over and saw a toddler in her backyard. A7 reported that the child entered through a loose fence board. A7 reported picking the toddler up and then approaching the fence to the neighboring preschool. A7 stated that as she approached the fence, she observed the individual she referred to as “the owner” (L1) also approaching the fence. Continue on LIC9099-C PAGE 3 A7 stated she was not sure how long C1 had been in her yard. A7 told LPAs that she asked L1 if she would like her to deliver the child to the front door, but L1 said to just "push her back through". A7 recalled hearing another staff in the yard state, “Oh my gosh”, in response to L1’s request. LPA's observed a fence board in A7's yard had been repaired from A7's side of the fence, during the time of the interview on today's date, 01/23/26. During today’s 01/23/26 visit, beginning at 11:38am LPA Strother interviewed L1 about the allegations. L1 denied both allegations. L1 stated that diapers are checked every 30 minutes but changed every 1.5 or 2 hours or as needed. L1 stated that a log of diaper changes is kept in the infant room, recording the time of the diaper change and if it was #1 or #2. L1 reported that all staff, including themselves, are responsible for diaper changes and that they always send children home in clean diapers, stating that if a parent arrives and they notice the diaper is not clean, they ask them to wait while they change it. L1 was not able to produce an example of a diapering log when asked. L1 stated that the children have always been supervised and that she can not recall ever being told that an infant was in the office unsupervised. L1 stated that she didn’t have any knowledge of a loose fence board in the play yard, and that no one had ever brought it to her attention that there was a loose fence board. L1 then stated that she did remember a teacher telling her about a loose fence board and then asked her husband to fix it and he did, but that she herself never observed it, stating she is unaware of which board it was. L1 denied having any knowledge of a child entering into the neighbor’s yard at any time. Based on LPA’s observations and interviews conducted, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22 is cited on the attached LIC9099-D. An immediate civil penalty is being assessed on LIC421IM in the amount of $500. This report was reviewed and discussed with Licensee, Monika Verma. Appeal Rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. Continue on LIC9099-C PAGE 4 LPA Strother informed licensee Monika Verma that this report dated 01/23/26 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Strother informed the licensee to provide a copy of this licensing report dated 01/23/26 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

  • BUILDINGS AND GROUNDS

    (a)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1)The licensee shall take measures to keep the center free of flies, other insects, and rodents.This requirement is not met as evidenced by: Based on interviews, observations and records received the facility had dead cockroaches present on 09/08/25, 11/04/25 and 11/05/25 and the licensee did not ensure that they were cleaned up before or while children were present, which poses a potential health, safety or personal rights risk to persons in care.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    (a) A comfortable temperature for children shall be maintained at all times. (1)The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C).This requirement is not met as evidenced by: Based on interviews, observations and records reviewed, the temperature in the classrooms felt cold and the preschool classroom was below 68 degrees on 11/05/25 and an unknown date, based on photographs of the thermostat, and today 1/23/26, which poses a potential health, safety or personal rights risk to persons in care.

  • PERSONAL RIGHTS

    (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: Based on interview 3 out of 6 parents reported their child having a full diaper at the time of pick up, which poses a potential health, safety or personal rights risk to persons in care.

    (c) The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations: (3) Absence of supervision, including, but not limited to, a child left unattended...This requirement is not met as evidenced by: Based on interviews with S1 and A7, infant C1 left the preschool yard without staff supervision on an unknown date in November 2025, entering the neighbor’s yard, where the neighbor and their dog were present, which poses an immediate health, safety or personal rights risk to persons in care.

  • REPORTING REQUIREMENTS

    (d)Upon the occurrence, during the operation of the child care center…a report shall be made to the Department by telephone or fax within the Department's next working day… In addition, a written report…shall be submitted to the Department within seven days…(1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement is not met as evidenced by: Based on interviews, licensee did not report child’s absence to the Department and did not submit a written incident report, which poses a potential health, safety or personal rights risk to persons in care.

    Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.This requirement is not met as evidenced by: Based on record review the facility roster was incomplete upon request, which poses a potential health, safety or personal rights risk to persons in care.
