What the inspector wrote

Licensing Program Analyst (LPA) Glenn Ouye arrived to deliver findings for the allegation that a staff member yelled at daycare child. During the prior visit on 4/25/24 on or about 9am, LPA Ouye was speaking with staff S2 and LPA heard staff S1 yelling at the children in the toddler room. LPA could tell from the immediate increase in volume and the inflection of S1's voice that she was frustrated with the children. LPA immediately looked at S2 and asked if that has occurred before. S2 said yes it has happened many times. S2 said that she had spoken with the licensee about S1 yelling at the children. LPA spoke with licensee on the phone. She was told by S2 that S1 was yelling at children and the licensee said that she just spoke with S1 about not yelling at the children and she also sent her to a training on how to communicate with children. Based on LPA's observation (witnessing) of staff S1 yelling at the children in the toddler room at 9am on 4/25/24 which was also observed by staff S2 the allegation that staff member yelled at daycare child which is a violation of the child personal rights. The allegation that Staff member yelled at daycare child is substantiated. The following violation of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 9099D. Appeal Rights were provided. This poses a potential health, safety, or personal rights risk to persons in care.

    Personal Rights-The licensee shall ensure that each child is accorded the following personal rights...To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This requirement was not met based on observation by LPA Ouye observing staff S1 yelling at toddlers which is a personal rights violation of the children in care.
