What the inspector wrote

An unannounced case management visit was made to the facility by Licensing Program Analyst (LPA) Y. Yang in response to a self-reported, lack of supervision incident involving child C1 and a staff member (staff S1) that occurred on 03/25/25. During today\342\200\231s visit, the LPA met with the assistant director, Maggie Petersen (staff S2) to discuss the incident and obtain additional details. Staff S2 stated that although she was on site at the time, she did not observe the incident. The facility\342\200\231s director Melissa \342\200\234Mel\342\200\235 Terhune (staff S3), whose first day working at the facility was on 03/18/25 was not present during today\342\200\231s visit nor was the center\342\200\231s former acting center director, Autumn Shafer (staff S4). The LPA interviewed staff S4 by telephone during today\342\200\231s visit. On 03/26/25, it was reported via written Unusual Incident Report (UIR) by then acting director Autumn Shafer (S4) that on 03/25/25 at approximately 11:25am, staff S1, who was with 12 preschool-age children on the center\342\200\231s "two's yard", transitioned her group of children back to their classroom and unintentionally left child C1 on the fully fenced two's yard. Staff S4 stated that the two's yard is adjacent to C1\342\200\231s classroom. Staff S4 stated that when she walked into the two's classroom to support S1 and assist with children\342\200\231s bathroom breaks, she observed C1 outside through the classroom\342\200\231s window. Staff S4 stated that she went outside through the classroom\342\200\231s exterior door and escorted C1 back to their classroom. Staff S4 stated that C1 did not appear to be upset or in distress. Staff S4 stated that based on her estimate, child C1 was left unattended on the play yard for approximately eight minutes. Staff S4 stated that this lack of supervision incident was not observed by any other staff member as they were all in their assigned classrooms at the time. Staff S4 stated that the facility\342\200\231s policy requires all staff to perform a face to name check any time children enter or exit a doorway. Staff S4 reported that due to this violation of Title 22 regulations and the facility\342\200\231s face to name check policy, S1 is no longer employed by the center. Based on available information, it has been determined that adequate supervision was not provided to child C1 during the incident on 03/25/2025. The following violation of the California Code of Regulations, Title 22; Division 12, was observed: see LIC 809D. This is a repeat violation, and a civil penalty will be assessed. This report was read and reviewed with the assistant director, Maggie Petersen. Notice of site visit shall be posted for 30 days. Appeal rights provided.

Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews conducted by the LPA with staff S2 and S4 on 04/11/25 and the Unusual Incident Report submitted by the facility on 03/26/25, it was corroborated that on 03/25/25 at approximately 11:25am, child C1 was left without supervision of a teacher for approximately eight minutes while on the center's two's play yard before being reunited with their class. This presents a potential threat to the health and safety of children in care.
