RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews conducted by the LPA with staff S2 and S4 on 04/11/25 and the Unusual Incident Report submitted by the facility on 03/26/25, it was corroborated that on 03/25/25 at approximately 11:25am, child C1 was left without supervision of a teacher for approximately eight minutes while on the center's two's play yard before being reunited with their class. This presents a potential threat to the health and safety of children in care.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance. All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement was not met as evidenced by: Based on a review of the personnel report on 01/07/25, Acting Center Director Shafer has received criminal record and child abuse index clearances or exemptions but is not associated to this facility.This poses a potential health, safety or personal rights risk to persons in care.

ALTERATIONS TO EXISTING BUILDINGS OR NEW FACILITIES

Alterations to Existing Buildings or New Facilities. Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s). This requirement was not met as evidenced by: The Department was not given prior notification of any proposed changes at the facility. This poses a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

Buildings and Grounds. All licensees shall ensure the inaccessibility of pools, including swimming pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds or similar bodies of water, through a pool cover or by surrounding the pool with a fence.This requirement was not met as evidenced by: Based on the LPA's observations on 01/07/25 at 11:15am, during an outdoor play yard walkthrough with Director Shafer and Assistant Director Petersen, the LPAs observed building materials, children’s play equipment (sand and water tables), and other plastic play furniture not intended for water use that have accumulated water at least several inches deep.This poses an immediate health and safety risk to the children in care.

PERSONNEL REQUIREMENTS

Based on the LPA's file review on 11/13/24, the licensee did not comply with the section cited above in CCR 101216(g)(2). Staff S6 did not have a current health screening report in their personnel file. This poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 1. General Provisions and Definitions

Based on the LPA's file review on 11/13/24, the licensee did not comply with the section cited above in HSC1596.7995(a)(1). Staff S1, S4, S6, and S7 did not have proof of immunity against measles and/or pertussis, which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on a file review on 11/13/24, five children's files did not contain a signed form LIC9224, which is required after receiving a Type A citation on 10/20/23. This poses a potenial health and safety risk to the children in care.

Based on the LPA's file review on 11/13/24, the licensee did not comply with the section cited above in HSC1596.8662(b)(1). Staff S5 and S6 did not have a current CA mandated reporter training certificate in their personnel file which poses a potential health, safety or personal rights risk to persons in care.

TEACHER-CHILD RATIO

Teacher-Child Ratio. There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by:Based on the LPA's interviews with facility staff and the center director Daysi Lemus’ own admission on 09/19/24, it was corroborated that the facility operated out of ratio on a specified date resulting in one staff member (S2) supervising 14 awake children. This posed a potential health and safety risk to the children in care.

This presents a potential threat to the health and safety of children in care.

REPORTING REQUIREMENTS

Reporting requirements. Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by: Based on the LPA's interviews, the center director, Jamie Poma admitted that incidents of staff S7 roughly handling children in care were not reported to the licensing agency as required by regulations. This posed a potential health and safety risk to the children in care.

BUILDINGS AND GROUNDS

Buildings and Grounds 101238(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by: Based on record review, the facility had two faucets "Site G" and "Site A" that exceeded that allowable levels of lead in the water. This is a potential health and safety risk to children in care.

FOOD SERVICE

Based on the LPA's observations and the center director's statement, the facility did not comply with the section cited above. The facility did not have any current menus posted or have any copies of past menus from the last 30 days available for review. This poses a potential health, safety or personal rights risk to persons in care.
