PERSONNEL REQUIREMENTS

(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities.This requirement was not met as evidenced by: Based on interview, Licensee stated at 1:47pm that no staff on site have a current Pediatric First Aid/CPR certificate, which poses a potential health and safety risk to children in care.

REPORTING REQUIREMENTS

Based on interview with L1 at 10:18am and record review of staff files the facility has a change of Director, L1 stated that she is now qualified to be the Director and has not yet notified the Department, which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on interview and record review, the licensee did not comply with the section cited above in two out of three staff files. Staff L1 and S2 did not have current Mandated Reporter Training certificates on file which poses a potential health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons.This requirement was not met as evidenced by: Based on interviews conducted and records reviewed S1 has yelled at day care child(ren) in care on more than one occasion, which poses a potential personal rights risk to the children in care.

PERSONAL RIGHTS

101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement was not met as evidenced by: Based on interviews conducted S1 has handled day care child in care in a rough manner on more than one occasion, which poses an immediate health, safety and personal rights risk to the children in care.

CHILD CARE CENTER DIRECTOR QUALIFICATIONS AND DUTIES

Based on interview and record review, the licensee did not comply with the section cited above and in the last 30 days has not hired a qualified Director after the former Directors last day on 07/19/22 which poses a potential health, safety or personal rights risk to persons in care.

HEALTH-RELATED SERVICES

(e)In centers where the licensee chooses to handle medications:(5)The licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. A review of C1's records indicates that the administration of medication given to C1 on 08/16/22 was not recorded. Staff interviewed had no knowledge of a written plan to do so, which poses a potential risk to the children in care.

(4)Nonprescription medications may be administered without approval or instructions from the child's physician if all of the following conditions are met: (B)For each nonprescription medication, the licensee shall obtain, in writing, approval and instructions from the child's authorized representative for the administration of the medication to the child.This requirement was not met as evidenced by: On 08/16/22 nonprescription medication was given to C1 without written approval from the child's authorized representative, which poses a potenial health and safety risk to the children in care.This requirement was not met as evidenced by:

REPORTING REQUIREMENTS

d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department...(1)Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidenced by: The facility was made aware that C1 was given a additional dose of a 12 hour medication that C1 had received prior to arrival and side effects of the overdose of medication were observed by Staff and C1's parent. A review of records indicated that this incident was not reported to the Department as required, which poses a potential health, safety and personal rights risk to the children in care.

PERSONAL RIGHTS

(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature…This requirement was not met as evidenced by: On 07/19/22 S1 picked up C1 and carried her to the hand washing line, scratching C1’s underarm, leaving a mark. It was reported by L1 that while C1 was crying, S1 told C1, “Waa, Waa, Waa, stop your crying”, which poses an immediate Health and Safety risk to children in care.

ARTICLE 2. Administration of Child Day Care Licensing

(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b.This requirement has not been met as evidenced by: Based on file review, Child 1 - Child 10 (C1-C10) files did not contain a signed form LIC9224 required after receiving a Type A citation on 08/04/21.

101239.1 Napping Equipment (d) Napping equipment shall be arranged so that each child has access to a walkway without having to walk on or over the cots or mats of other children.This requirement is not met as evidenced by: Based on staff interviews staff corroborate that on more than one occasion the nap mats in the toddler room did not have enough space to walk between them and were sometimes touching. This poses a potential health and safety risk to the children in care.

This poses an immediate health and safety risk to the children in care.

(a)The licensee shall immediately notify the child's authorized representative…(2)In the case of less serious injuries including, but not limited to, minor cuts, scratches…the licensee shall document the injury in the child's record and notify the child's authorized representative of the nature of the injury when the child is picked up from the center.This requirement is not met as evidenced by: Based on staff interview, L1 has instructed staff that they may not communicate with children’s authorized representative’s, injuries have occurred, and L1 was not present at the facility to report the incident or chose not to report an incident to a child’s authorized representative. This poses a potential health and safety risk to the children in care.

FOOD SERVICE

101227 (a)...(1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified...for the age group served...This requirement is not met as evidenced by: Based on staff interviews milk is only served to the children if they request it and a milk alternative is not served to children with milk allergies.This does not meet the requirement for each meal to include milk. This poses a potential health and safety risk to the children in care.

FOOD SERVICE

101227(a)...the following shall apply: (6) Menus shall be in writing and shall be posted...in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept...for least 30 days. Menus shall be made available for review...upon request.This requirement is not met as evidenced by: Based on staff interviews menus were not posted prior to April 2020. This poses a potential health and safety risk to the children in care.

BUILDINGS AND GROUNDS

101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents.This requirement is not met as evidenced by: Based on staff interviews rodent droppings and spiders have been observed in the facility in March 2020. Based on record review the facility is serviced for ants/carpenter bees only. This poses a potential health and safety risk to the children in care.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance(e) ...prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 101170(f).This requirement is not met as evidenced by: Based on staff interviews and record review A1 and S6 were working and not associated to the facility and a transfer request was not completed which poses a potential safety risk to the children in care.

BUILDINGS AND GROUNDS

101238 Buildings and Grounds (a)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement is not met as evidenced by: Based on staff interviews, on more than one occasion rusty nails and screws were found by children on the playground after it was brought to L1’s attention. This poses an immediate health and safety risk to the children in care.

PERSONAL RIGHTS

Personal Rights. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.This requirement is not met as evidenced by: Based on staff interviews D1 pull on the arms of multiple children on more than one occasion, handling the children in care roughly. This poses an immediate health and safety risk to the children in care.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

101239 Fixtures, Furniture, Equipment and Supplies (e) Faucets used by children for personal care shall deliver hot water. (4)All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition…This requirement is not met as evidenced by: Based on interviews with L1 and S1-S3 and S5-S6, the hot water heater in the school age room has an issue that causes the sink water to smell like rotten eggs, and the preschool children use the school age bathroom sink when playing outside to wash their hands. This poses a potential health and safety risk to the children in care.

(b)The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1)A ratio of one fully qualified teacher (as specified in Section 101216.1(c) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d).This requirement is not met as evidenced by: Based on staff interviews the preschool has had more than 15 children, and up to 20 children in care on more than one occasion with one qualified teacher and 1 or two aides that do not hold units in Early Childhood Education. This poses a potential health and safety risk to the children in care.

This requirement is not met as evidenced by video footage, photo documentation and statements by facility staff that S1 smacked his hand on C1’s right arm several times, causing red marks to C1’s right arm on 04/16/21 at 9:09am. This poses an immediate health and safety risk to the children in care.

1596.8662 Availability of information regarding...reporting child abuse...proof of completion. (b)(1)On or before March 30, 2018,...licensed child care provider...shall complete the mandated reporter training...and shall complete...every two years...This requirement is not met as evidenced by: Based on interview, L1 did not have S1 and S2 complete their Mandated Reporter Training as required, which poses a potential Health, Safety or Personal Rights risk to the children in care.
