What the inspector wrote

A required one year inspection was made to the facility by Licensing Program Analyst (LPA), Amy Strother. LPA met with Licensee, Jeanette Boehm (L1). The facility file was reviewed prior to this visit. A review of the personnel report on file indicates that all facility staff have received criminal record and child abuse index clearances or exemptions. Facility representative, Jeanette Boehm was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. This center is a preschool with a toddler component. Children of different age groups have separate activity areas. The facility’s operating hours are 6:00am - 6:00pm, Monday – Friday. The facility was toured inside and outside, and the floor and yard plan submitted by the licensee were verified. Sign in/out records were reviewed and in compliance, facility uses the BrightWheel App. Items which could pose a danger to children (such as detergents, cleaning compounds and medications) were observed to be inaccessible to children located on high shelves out of reach of children. L1 stated there are no poisons in the facility, and none were observed during this inspection. LPA observed the toys, floors, desks and other equipment and surfaces are clean, toxic free, safe, and in good condition. There is uncontaminated drinking water available to children indoors and outdoors by individual water bottles, filled in the kitchen using the refrigerator water dispenser. The children's bathrooms are in safe and sanitary condition. The center’s isolation area for any child who becomes ill while in care is located in the office on a nap mat. LPA observed food prep areas are clean. Food is properly stored and refrigerated as needed. There was no contaminated food observed. Garbage cans containing solid waste have tight fitting lids. Menus are posted in the front entry of the school and in each classroom. There is a working smoke detector, carbon monoxide detector and fire extinguisher in the facility. LPA observed the playground equipment and surface areas were in safe condition. Continued on LIC 809-C. There is wood chip cushioning underneath climbing structures and/or play equipment to absorb falls. There were no bodies of water observed on site. L1 stated no weapons are stored on site, and none were observed. During today's inspection, staffing ratios were being met, a total of 7 preschool children were being supervised by 5 staff, 2 teachers and 3 aides in the preschool classroom and 6 toddlers were supervised by 2 staff, 1 teacher and 1 aide in the toddler room. The facility was operating within the licensed capacity and ratio requirements. At least one staff member present during the inspection possessed current CPR and First Aid certifications, which expire 11/05/23. Ten children’s records were reviewed and contained complete and current information as required. 3 teacher files were reviewed and contained all records as required. Interview conducted with L1 indicates that the facility does not have a qualified Director on site and has not had a Director since 07/19/22. This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. The following violation of the California Code of Regulations, Title 22; Division 12, was observed: see LIC 809D. Appeal Rights were provided.     Based on interview and record review, the licensee did not comply with the section cited above and in the last 30 days has not hired a qualified Director after the former Directors last day on 07/19/22 which poses a potential health, safety or personal rights risk to persons in care.

    d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department...(1)Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidenced by: The facility was made aware that C1 was given a additional dose of a 12 hour medication that C1 had received prior to arrival and side effects of the overdose of medication were observed by Staff and C1's parent. A review of records indicated that this incident was not reported to the Department as required, which poses a potential health, safety and personal rights risk to the children in care.

    (4)Nonprescription medications may be administered without approval or instructions from the child's physician if all of the following conditions are met: (B)For each nonprescription medication, the licensee shall obtain, in writing, approval and instructions from the child's authorized representative for the administration of the medication to the child.This requirement was not met as evidenced by: On 08/16/22 nonprescription medication was given to C1 without written approval from the child's authorized representative, which poses a potenial health and safety risk to the children in care.This requirement was not met as evidenced by:

    (e)In centers where the licensee chooses to handle medications:(5)The licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. A review of C1's records indicates that the administration of medication given to C1 on 08/16/22 was not recorded. Staff interviewed had no knowledge of a written plan to do so, which poses a potential risk to the children in care.
