What the inspector wrote
Licensing Program Analyst (LPA) Aurelio Mendoza conducted an unannounced Required 3-Year Inspection for the facility\342\200\231s infant license. Upon arrival, LPA met with Staff #1 and conducted a comprehensive tour of the facility, both indoors and outdoors. The facility provides infant daycare services Monday through Friday, from 6:30 a.m. to 4:00 p.m.
All poisons are stored in locked areas, and none were observed during the inspection. Disinfectants, cleaning solutions, medications, and other hazardous materials were stored so as to be inaccessible to children. The premises have no swimming pool or other bodies of water. There are also no firearms or ammunition on site. While no in-ground pool is present, LPA discussed the new pool safety requirements under AB 2866, effective January 1, 2025, and informed Staff #1 about Provider Information Notice (PIN) 25-01-CCP, issued January 6, 2025, in case future installation of an in-ground pool is considered.
All furniture and equipment were in good repair and free of sharp, loose, or pointed parts. Playground equipment was in safe condition with no hazards noted. The outdoor activity space was well maintained, and areas around climbing structures and slides were cushioned to absorb falls. Toilets and handwashing stations were sanitary and in good working order. The facility is equipped with at least one functioning carbon monoxide detector. Floors were clean and safe, and all solid waste containers had tight-fitting lids and were in good condition.
Drinking water is available to children both indoors and outdoors. The facility uses a filtration system, with filters serviced annually by a water service company, per Staff #1. Teachers carry thermoses or water containers to fill as needed. Outdoors, children are provided disposable cups; indoors, they use facility-provided plastic cups. The facility provides breakfast, lunch, and snacks, with all food prepared on site. Menus are posted at least one week in advance in a location accessible to authorized representatives.
Capacity and limitations on the license were being maintained. At least one staff member with current CPR and Pediatric First Aid certification was present during care hours and offsite activities. The name of the facility director or designated acting director has been reported to the Department. All children were under visual supervision at all times, and staffing met the required teacher-child ratios.
A sample review of children\342\200\231s files showed complete records, including emergency contact information, medical assessments, Infant Needs and Services Plans, and Individual Infant Sleeping Plans. Staff files reviewed were complete with health screenings, required immunization records (influenza, pertussis, and measles), current mandated reporter training certificates, and documentation confirming that all infant caregivers met the required educational qualifications.
LPA discussed the Community Care Licensing Division (CCLD) website (

) as a resource for forms, regulations, Provider Information Notices (PINs), and quarterly updates. Reporting requirements, per Section 101212, were also reviewed. LPA reminded Staff #1 that all adults 18 years or older, including employees and volunteers (with exceptions noted in Health and Safety Code section 1596.871), must obtain a criminal record clearance or exemption or transfer an existing clearance prior to being present at the facility. Violations are subject to a civil penalty of $100 per day, up to five days, or up to 30 days for repeat violations.
Assembly Bill (AB) 2370 requires licensed child care centers constructed before January 1, 2010, to test water used for drinking and food preparation for lead before January 1, 2023, and every five years thereafter. Centers licensed after July 1, 2022, must test within 180 days of licensure. LPA verified the facility\342\200\231s compliance with lead testing requirements under Written Directives section 101700 and referred Staff #1 to the Department\342\200\231s water testing resource webpage.

). LPA advised checking the U.S. Consumer Product Safety Commission (CPSC) website (

) for recalled infant devices and encouraged registration of all equipment with the CPSC for recall notifications.
At the time of inspection, no infants required an Incidental Medical Services (IMS) Plan. LPA reviewed IMS policy and provided PIN 22-02-CCP for reference. When IMS is provided, the licensee must submit an updated Plan of Operation to the Department. LPA also informed Staff #1 of the MyChildCarePlan.org consumer education website, which connects families with child care providers and local Resource & Referral Agencies.
An exit interview was conducted, and the report was reviewed with Staff #1. Appeal Rights were provided. No deficiencies were cited under Title 22, Division 12 of the California Code of Regulations. A LIC 9213 Notice of Site Visit was issued and must be posted for 30 days. This report is public record and must be made available upon request.
