What the inspector wrote

On 5/28/2025, Licensing Program Analyst (LPA) Miguel Herrera conducted an unannounced Case Management Inspection. LPA met with Director, Heidi Nunes. LPA toured the facility, and a census was taken. The purpose of today's inspection was regarding an Unusual Incident that was self reported to the Fresno Childcare Regional Office on 04/29/2025. The incident reported was pertaining to a child's personal rights being violated by another child. During today\342\200\231s visit LPA interviewed staff, reviewed records and conducted facility observations. LPA also obtained and reviewed facility records pertinent to the incident. During the facility tour LPA conducted facility observations including the outdoor play area. LPA observed that the child involved in the alleged incident continues to attend the facility. LPA Herrera observed that the facility practices proper supervision of children inside and outside the classroom. The facility practices zoning in the outdoor space to ensure children are always supervised and that there is a direct view of each zone in the outdoor space. Furthermore, it was an isolated incident, and staff took appropriate measures to address the alleged incident, following appropriate policies, regulations, and reporting requirements. The facility also has proper measures in place regarding children distinguishing good touches from bad touches, as well as keeping their hands to themselves. Teacher/child ratios are maintained, and adequate supervision is being provided during this visit. Exit interview conducted and report was reviewed with Director, Heidi Nunes and appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, no deficiencies are cited. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

    101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature.... This requirement was not met based on evidenced of records reviewed, photos and interviews. LPA Herrera obtained corroborating interviews, photos, and documentation that revealed staff #1 rough handled and pulled on child #1’s hair, which posed an immediate risk to the health, safety and/or personal rights to children in care.
