What the inspector wrote

On 04/03/2025, LPA observed 13 children in care, including 3 infants (0\342\200\22324 months) and 10 preschool-aged children (ages 2\342\200\2235), with one assistant present. The licensee had one child picked up during the visit, bringing the facility into compliance. Documentation from a food program inspection on 03/19/2025 shows 5 infants and 10 preschool-aged children were in care with one assistant, exceeding both the allowed infant ratio and total capacity. Per Title 22, Section 102416.5(d), a Large Family Child Care Home with an assistant may care for up to 12 children, including no more than 4 infants. Care for up to 14 children is allowed only if at least two meet school-age requirements. Section 102416.5(f) states the total licensed capacity shall not exceed 14. The number and ages of children in care on both 03/19/2025 and 04/03/2025 confirm the licensee was operating out of ratio and out of capacity. The preponderance of evidence standard has been met; therefore, the findings for both allegations are SUBSTANTIATED. This poses an immediate risk to the health, safety, or personal rights of children in care. Per Title 22, Division 12, Chapter 3, two Type A deficiencies are cited on the attached LIC 9099D. An exit interview was conducted with Licensee Patricia Gudino. A copy of this report and Appeal Rights were provided and discussed. A Notice of Site Visit was issued and posted and must remain posted for 30 days. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LPA provided the Fact Sheet \342\200\223 Child Care Parent Notification Requirements and a copy of LIC 9224 to Licensee Patricia Gudino. (End of Report)
