    OPERATION OF A FAMILY CHILD CARE HOME

    (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. Based on LPA interviews and information received, Licensee did not provide adequate supervision for children in care. Licensee did not comply with the section cited above which poses a potential health, safety, or personal rights risk to persons in care.

  • PERSONAL RIGHTS

    (a) Each child receiving services from a family childcare home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:(1) To be treated with dignity in his/her personal relationship with staff and other persons. Based on LPA interviews and informations received, a child’s personal rights were violated. Licensee did not comply with the section cited above which poses an immediate health, safety, or personal rights risk to persons in care.

  • REPORTING REQUIREMENTS

    Reporting Requirements…(d) The licensee shall report to the Department as provided by Health and Safety Code Sections 1597.467(b)(1) and (2)…"A report shall be made to the department by telephone or fax during the department's normal business hours before the close of the next working day following the occurrence during the operation of family day care home of…the…events." (2) Health and Safety Code Section 1597.467(b)(2) provides: "In addition to the report required pursuant to paragraph (1), a written report shall be submitted to the department within seven days following the occurrence of any events specified in paragraph (A) Child's name, age, sex and date of admission...D) Disposition of the case."

    (d) All personnel records shall be maintained at the child care home and shall be available to the licensing agency for review.Based on record review, the licensee did not comply with the section cited above in that Licensee did not have a file with required licensing documents for Assistant which poses a potential health, safety, or personal rights risk to persons in care.
