What the inspector wrote

On 06/06/2024 Licensing Program Analyst (LPA), Miguel Herrera conducted an unannounced Annual Required Inspection and was met by licensee Guadalupe Davila. Days and hours of operation are Monday through Friday, 6:30am to 4:30pm. LPA toured the home inside and outside and a census was taken. LPA reviewed current facility sketch and confirmed that the kitchen, bathroom, living room and backyard are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of a baby gate, and doorknob spinners . There is a built-in swimming pool in the backyard which is fenced and made inaccessible by a 4-foot iron rod fence that connects to the home\342\200\231s wall on one side and to a brick wall on the other side. An additional lattice fence is secured to the iron fence with zip ties, extending the overall fence to 5 feet in height. The rod iron fence is bolted to the concrete floor. The pool gate latch is broken therefore it doesn't self close and self latch. Licensee Davila stated that the backyard was off-limits due to the pool gate latch breaking yesterday and she is temporarily using a copper wire to close the gate while repairs are made. Licensee Davila stated that she will fix the broken latch and will also modify the iron fence with a more permanent addition to extent the fence to 5 feet in height to comply Title 22 regulations. LPA Herrera also observed that the daycare room\342\200\231s window did not have direct access to the pool area. Additionally, LPA Herrera inspected the new play structure in the backyard for approval of use by day-care children. LPA Herrera observed that the play structure was secured and had no visible defects. LPA Herrera was able to review the manufacture guidelines and observed the playground was intended for children 18 months of age to 7 years of age. LPA Herrera noticed a warning sticker on the play structure stating that the play structure should not be installed on top of a hard surface due to a risk of injury from a fall. The play structure was placed on top of concrete with an extra thin layer of turf which did not provide enough cushioning in case of a fall. Therefore, LPA Herrera did not approve the play structure for immediate use until licensee provides appropriate cushioning material under and around the play structure and until the pool fence meets regulations. Licensee Davila understood the concern and stated that she was going to install rubber tiles around the play structure to minimize the impact of a child falling on a hard surface. To be continued on 809-C. There are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible. There is one fireplace in the home located in the living room and is made inaccessible by a screen and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. LPA Herrera observed an up-to-date fire drill that documents time, date and how many children were present. This is a two-story home and stairs are gated when children under age 5 years old are present. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is 408-796-9163. Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. The outdoor play area in the backyard is fenced. Capacity as specified on the license is being maintained. LPA reviewed a sample of children\342\200\231s files and observed files were complete with emergency information as required. Licensee\342\200\231s Mandated Reporter Training expires on 07/19/2024. Licensee\342\200\231s pediatric CPR/First Aid certification expires on 08/2024. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2). Licensee Davila was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Continued on 809-C. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see LIC 809-D). Licensee Guadalupe Davila was provided appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

    Based on observation, the licensee did not comply with the section cited above. LPA observed the pool gate was not self-closing and self-latching as the latch bolt was broken. Furthermore, the rod iron fence was 4 feet tall, and a lattice was secured by zip ties to the iron fence to extend the overall fence to 5 feet in height. However, the lattice extended to the ground which provided children support to climb the fence by putting their feet in the diamond openings of the lattice fence. Although Licensee stated that the backyard was offlimits due to the pool gate latch breaking yesterday and temporarily using a copper wire to close the gate, it still poses a potential health, safety, or personal rights risk to chidlren in care.
