On 10/11/2022, Licensing Program Analysts (LPA\342\200\231s) Ruby Ocegueda and Daniel Alvarez conducted a case management inspection. Today, LPA\342\200\231s met with licensee Alma Nunez and informed her of the reason of the inspection which was to follow up on concerns regarding her rod iron pool gate. A tour of the home was conducted, and a census was taken. Licensee has an in-ground pool at her facility. Today, LPA\342\200\231s inspected the pool gate off the master bedroom exit. During a previous inspection on 8/12/2022, LPA Ocegueda observed that that specific door opened inward toward the pool instead of away from the pool as required. After review of previous inspections, consultation and interviewing licensee, it was determined that the gate door near the master bedroom was approved in this condition during pre-licensing. Today, LPAs Ocegueda and Alvarez also re-inspected the back yard and pool area and measured the existing rod iron gate. It was determined that some areas of the rod iron gate were not the required height. LPA\342\200\231s showed the licensee which areas were not 5 ft in height as required. In addition, part of the pool fence that was previously there was removed, thus making the area of the pool accessible through a garage bay door and a pool gate door that swung inward, not outward as required. Today, LPA Alvarez discussed with licensee some options to ensure her pool fence was within all the regulation requirements. Today, licensee stated she will be adding rod iron fence towards the back car port that will make the pool inaccessible and also will be reconfiguring the pool gate door near the master bedroom to open away from the pool. Licensee will also be raising the rod iron pool gate panels to the 5 ft height requirement while ensuring that the bottom opening is no more than 4 inches from the cement ground. LPA Alvarez also demonstrated the deficiencies to husband/assistant today as he will be assisting in bringing the gate back to regulation requirements. Licensee stated she could fix the pool gate within two weeks. A return inspection will be conducted to ensure all areas of fencing and pool entrance are within Title 22 requirements. An exit interview was conducted with licensee Alma Nunez. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency was cited: (see 809-D). Appeal Rights were provided. Notice of Site Visit 9213 to be posted for 30 days.
