    Conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California. Based on LPA observations, Licensee did not comply with the section cited above. LPA has observed on several occasions Licensee exhibiting aggressive, combative, and non-cooperative behaviors interfering and impeding inspections and investigations. This poses a potential risk to the health, safety, or personal rights of persons in care.

    Personal Rights (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged. These rights include… (2) To receive safe... accommodations, furnishings, and equipment. This requirement was not met as evidenced by: Based on interviews and record review, Licensee did not comply with the section cited above. Licensee did not prevent inappropriate use of equipment which resulted in C1 breaking their arm which posed an immediate health, safety or personal rights risk to persons in care.

    Based on LPA observation, the licensee did not comply with the section cited above. LPA observed observed front yard to have accessible garden tools, dog toys, and dog feces in the grass which poses a potential health, safety or personal rights risk to persons in care.

  • OPERATION OF A FAMILY CHILD CARE HOME

    Based on observation the licensee did not comply with the section cited above. Today, inside the day care room, LPA observed vitamins, a lighter, eye drops and batteries on top of an adult desk. In the accessible restroom there was glass cleaner, pet deoderizer under the accessible sink. Outisde in the play yard were accessible pruners and an unlocked shed that had a gas can. This poses a potential risk to the health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above. During file review, LPA observed that 4 out of 5 files (child #2, child #3, child #4, child #5) did not have immunization records on file. Licensee stated they were in the facility but could not find them today. This poses a potential health, safety or personal rights risk to persons in care.

    To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature...this requirement was not met as evidencend by: interviews. LPA discovered via multiple corroborating interviews that licensee and or staff participated in hair pulling, inappropriate discipline, use of profanity, and mishandling of children in care which is a violation of Personal Rights. This poses an immediate risk to the health, safety and or personal rights of children in care.

This requirment was not met as evidenced by: record review. Licensee could not provide proof of completion of the required AB1207 Mandated Reporter Training.
