What the inspector wrote

On 4/10/2025, Licensing Program Analyst (LPA), Norma Lomeli conducted a capacity increase inspection from a Small Family Child Care Home to a Large Family Child Care Home. Present at time of inspection was licensee and three day care children who were getting ready to take nap in the living room. Licensee, her husband and three minor child reside in the home. Verified licensee\342\200\231s CPR and First Aid was completed through American Red Cross expires on 1/4/2025. Licensee\342\200\231s Assistant, Josefina Avila completed the training through American Red Cross and expires on 2/9/2026. Background criminal record clearances are verified and discussed, and LIS 531 is signed indicating that the adults living in the home and/or providing care and supervision to children have a criminal record clearance. Fire clearance was granted on 3/6/2025. A tour of the home, inside and outside, as shown on the facility sketch, was conducted and the following was discussed and/or observed: Fire clearance was received on 3/11/2025. Licensee states that fire inspector did not require for her to install a fire pull alarm. LPA observed children size furniture, safe toys and books for the children. LPA also observed one high chair and one play yard. There is a flat screen television mounted onto the living room wall. There is a parent\342\200\231s board that is located on the right wall of the home\342\200\231s entry way. Licensee states she does not have weapons, firearms, ammunition or poisons in the home. (Continued on LIC809-C): Facility has 3A40BC fire extinguisher mounted the laundry room wall. There is a functioning carbon monoxide alarm, working smoke alarm and first aid kit in place. LPA observed in the backyard, two small dogs, 10 chickens inside a chicken coop and a goat in the same coop. Licensee is advised at least one staff member with current training in pediatric first aid and pediatric CPR is to be on site at all times children are present. Licensee is advised that smoking is prohibited on the premises of a family child care home as specified in Health and Safety Code Section 1596.795(a). Licensee states the home is smoke-free. Licensee states she does transport day care children. Licensee understands that she must have proper restraints and/or car seats for all the children under her care when transporting children. Required items are posted in the Child Care Home where parents may easily view. During visit capacity worksheet was provided and discussed. Licensee completed the Mandated Reporter Training on 3/10/23. Licensee\342\200\231s Assistant completed the training on 1/30/2025. Licensee is advised Fresno Community Care Licensing Department has inspection authority and can inspect all rooms in the home, garages and/or separate dwellings on the premises. Licensee is advised it is her responsibility to read and maintain the family child care home incompliance with Title 22 Regulations. Title 22 Regulations can be found at www.ccld.ca.gov . LPA observed an in-ground pool. LPA advised licensee, effective 01/01/2025, all childcare facilities licensed by CCL by law will be required to adhere to AB2866 - The Pool Safety Act. According to Health & Safety Code 1596.814, additional safety features will be required. LPA observed an in-ground pool that is fenced on one side with black wrought fencing and the other side with black mesh fencing. The gate is self-latching/self-closing, swings away from the pool but does not have a key lockable device that must be located no more than six inches from the top of the gate. LPA observed a 20" life ring approved by the US Coast Guard that is mounted on the wooden fence inside the pool area. (Continued on LIC809-C): There is a rescue pole with a body hook fixed length of 12 feet and an alarm placed in the swimming that will sound when detecting entrance into the water and meets ASTM International Standard F2208. LPA & licensee discussed the Community Care Licensing website: LPA and licensee discussed new additions to the website that include the new PIN (Provider Information Notification) and information for providers including the Quarterly Update that informs licensees of new legislation and regulations. Please follow these steps go to http://www.cdss.ca.gov/ , click on \342\200\234information and resources\342\200\235 click \342\200\234Community Care Licensing\342\200\235 Click \342\200\234quarterly updates\342\200\235 click \342\200\234Child Care advocates program\342\200\235 and register to PIN. Licensee states her hours of operation are Monday through Friday from 6:00 AM to 5:30 PM and Saturday from 6:00 AM to 5:00 PM and as arranged. No overnight care is provided. Licensee advised she does not provide care for more than 24 hours. Licensee is advised she may access forms and updated information on the CCLD website at www.ccld.ca.gov . Licensee is advised the following items must be corrected and documentation be sent to Fresno CCL within the next 30 days to avoid possible withdraw. Licensee will adhere to the AB2866 - The Pool Safety Act. Applicant will obtain the additional requirements as listed. Licensee will install a key lockable device to the pool gate. Pending verification of corrections of the above items, licensee agrees to contact LPA to inform that her FCCH in incompliance and a second unannounced case management inspection will be conducted, licensure as a Large Family Day Care Home capacity of 14 children ages under 18 years will be recommended. During exit interview, LPA observed licensee post the Notice of Site Visit on parent\342\200\231s board and understands it must remain posted for 30 days and retain evaluation report for 3 years.

This requirement was not met as evidenced by: record review and interview. Licensee provided LPA with proof of required Mandated Reporter Training (AB1207) completed on 3/10/23. Licensee will need to update training. This poses a potential risk to the health, safety and/or personal rights of children in care.
