Based on observation, the licensee did not comply with the section cited above as LPA observed spa cover was not locked. The spa cover has two latching devices with the capability to lock but the licensee was unable to find the key. Licensee stated the spa has not been used since last spring which poses an immediate health, safety or personal rights risk to persons in care.

The home shall be free from defects or conditions which might endanger a child. This requirment was not met as evidenced by: observation and interview. LPA observed that a latch was broken on the spa cover. The spa remained inacessble, however LPA reviewed requirement for home to be free of defects. This poses a potential risk to the health, safety and or personal rights of children in care.
