What the inspector wrote

Also LPA conducted staff and witness interviews. From these interviews, LPA discovered. Child#2(C#2), displayed aggressive behavior towards daycare children and staff. Two of the witnesses interviewed identified the child as C#2. One witness (witness#1) confirmed C#2 left a center staff injured and this required medical attention (see LIC812). Another witness(witness#2) confirmed C#2 displayed extreme aggressive behavior. Director also stated, C#2's day care services had to be terminated due to escalating behavior and due to the program not being an appropriate placement for C#2. As mentioned LPA reviewed children files. Through this review, LPA discovered C#2 is no longer enrolled. Also LPA discovered multiple incidents, of C#2 hurting other day care children. Furthermore, LPA conducted a review of unusual indents that were self reported to the department. LPA could locate any unusual incident pertaining to C2's aggressive behavior, that was reported to child care licensing. Regarding Allegation#2 Center is failing to meet the needs of the child. As mentioned LPA conducted a review of children files and LPA discovered : Child#2 displayed repeated aggressive behavior. Also director stated C#2 due to the program not being an appropriate placement for C#2. Furthermore, documents collected during the investigation, revealed C2's behavior was interfered with the needs of other day care children(see LIC812). Also through staff and witness interviews, LPA discovered multiple center staff believe they are not equipped or trained to meet the needs of children who display challenging behavior(see LIC812). Additionally one staff stated the center enrolls children who have special needs, and the center staff constantly advocates for these children, to receive specialized services plans, however due to lack of training, there have been instances were staff feel overwhelmed and have quit. Based on LPA interviews, documents collected during investigation, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Type B deficiency is being cited today (LIC9099-D). Appeal rights and notice of site visit was provided to site supervisor.

Based on interviews and documents collected the above mentioned regulation was not met, C#2 dispalyed agressive behaviour towards other children in care. There were multiple incidents, which includes a 2/22/25 incident where C#2 kicked C#1 in the face one report stated it was accdientally another report stated it was not accidentally.
