RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
(a) The licensee shall provide care and supervision as necessary to meet the children's needs...(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met as evidence by ...LPA arrived at the facility. LPA waited for approximately 5 minutes for someone open the gate entrance. LPA observed Assistant Director open the door in room#6. Assistant Director allowed a preschool child (C7) to walk out of room#6 in order to allow C7 use the restroom. Once Assistant Director observed C7 enter the restroom, Assistant Director close the door and went into room#6. LPA was allowed inside by a infant teacher(See LIC811). LPA observed C7 walk out of the restroom and walk back to room#6 unsupervised.

(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department orThis requirement is not met as evidenced by: Based on observation, interview, and record review, the Director did not comply with the section cited above. When touring the facility, LPA asked staff (S1) to provide her name. LPA reviewed records and it was determined S1 was not associated to the facility or been fingerprint cleared. Director stated S1 has been working at the facility since 2/16/2022 which poses an immediate health, safety or personal rights risk to persons in care.
