87468.2(a)(4) Additional Personal Rights of Residents in Privately Operated Facilities(a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights:(4) To care, supervision, and services that meet their individual needs and are delivered by staff that are sufficient in numbers, qualifications, and competency to meet their needs.This requirement is not met as evidence by: Based on interview and records review, Administrator failed to ensure that a resident’s care needs were not met, which poses a potential health, safety or personal rights risk to persons in care.

80012 False Claims(a) No licensee, officer, or employee of a licensee shall make or disseminate any false or misleading statement regarding the facility or any of the services provided by the facility. This requirement was not met as evidence by; Based on LPA record review, and interviews ECP electronic records and iServe records states that medication was not giving to resident, but was checked off as given.

80075 Health Related Services(b) Clients shall be assisted as needed with self-administration of prescription and nonprescription medications. This requirement was not met as evidence by; Based on LPA record review, and interviews ECP electronic records and iServe records shows that medication was not given as precribed by PCP.

(a) Disinfectants, cleaning solutions, poisons, firearms and other items which could pose a danger if readily available to clients shall be stored where inaccessible to clientsThis requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. Storage where knives are kept was observed unlocked and medication drawers was unlocked which poses an immediate health and safety risks to persons in care.

PERSONNEL REQUIREMENTS(a) Facility personnel shall be competent to provide the services necessary to meet individual client needs and shall, at all times, be employed in numbers necessary to meet such needs.This requirement is not met as evidenced by: Based on interview and record review, Licensee did not comply with regulation cited above. LPAs observed 2 staff were scheduled in PM shift and 1 to 2 staff in NOC shift for the month of February and March which poses a potential health and safety risk to persons in care.

87465 (c) If the resident's physician has stated in writing... facility staff designated ...shall be permitted to assist the resident with self-administration, provided all of the following requirements are met: (2) Once ordered...the medication is given according to the physician's directions. This requirement was not met as evidenced by: Based on LPA interview Staff (S1) did not comply with the regulation stated above which poses a potential health and safety risk to the resident.
