87468.1(a)(3) Personal Rights of Residents in All Facilities: To be free from punishment, humiliation, intimidation, abuse, or other actions of a punitive nature; such as, withholding residents money or interfering with daily-living functions; such as, eating, sleeping, or elimination. This requirement is not met as evidenced by: Staff #1 admitted the purpose of the restraints and expressed the necessity to occasionally restrain Resident #1 in different positions. This violation poses an immediate health and safety risk to residents in care.

Based on observation the licensee did not comply with the section cited above as LPA observed facility walls to be dirty, paint is chipping off and walls have spider webs which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, interview, record review, the licensee did not comply with the section cited above as LPA did not observe an active administrator certificate posted at the facility nor in Administrator file. Expired certificate observed, experation date : 11/13/2021. Facility staff could not provide proof of active admin certificate at the time of visitwhich poses/posed a potential health, safety or personal rights risk to persons in care.

First aid training requirements

(a) Based on the individual's preadmission appraisal, Postural supports may be used under the following conditions.(3) A written order from a physician indicating the need for the postural support shall be maintained in the resident’s record. Provide resident hot water for personal care

Maintenance and OperationFaucets used by the staff in the kitchen shall deliver hot water. Hot water temperature controls shall be maintained to automatically regulate the temperture of hot water used to attain a temperature of not less than 105 degrees F and not more than 120 degree F.This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA found water temperature in kitchen to be 120.8, which poses an immediate health, safety or personal rights risk to persons in care.

(c)clean linen, including blankets, bedspreads, top bed sheets, bottom bed sheets, pillow cases, mattress padsThis requirement is not met as evidenced by: Based on observation, the licensee did not ensure that residents were provided proper linens for bedding, which could pose as an immediate health and safety risk to persons in care.

Store disinfectants separately from food supplies

(a) Disinfectants, cleaning solutions, poisons, firearms and other items which coluld pose a danger if readily available to clients shall be stored where inaccessible to clients. (1)Storage areas for poisons, and firearms and other dangerous weapons shall be locked.This requirement was not met as evidenced by: Based on observation the licensee did not comply with the section cited above by having toxins accessible to clients which poses an immediate health and safety risk to persons in care.

Store centrally held medications in locked secure place

Based on observation the licensee did not comply with the section cited above drawer with knives and closet with scissors were found unlocked. Which poses an immediate health and safety risk to persons in care.

Use slip-resistant surfaces in bathing areas

Based on [(observation), the licensee did not comply with the section cited above. Facility bathoom did not have a non skid mat, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation the licensee did not comply with the section cited above. LPA found water temeperature in bathroom and kitchen to be over 150F, which poses an immediate health, and safety risk to persons in care.

Maintain facility in clean, safe, sanitary condition

87303(a) The facility shall be clean, safe,sanitary and in good repair at all times.Maintenance shall include provision ofmaintenance services and procedures for thesafety and well-being of residents, employeesand visitors.This requirement is not met as evidenced by: Based on observation, LPA observed a resident dresser on R4 room without handles to open the drawer at the facility which poses a potential health and safety risk to persons in care.

Hot water temperature controls shall be maintained to automatically regulat the temperature of hot water used by residents to attain a temperature of not less than 105 degrees F and not more than 120 degrees F.This requirement is not met as evidenced by: Based on observation by LPA, the water tempeerature in the kitchen sink measured 130.5 F at 10:06am and 130.8 F at 10:18am in the shared bedroom bathroom which poses an immediate health andsafety risk to persons in care.

Ensure hazardous items are locked and not unattended

87309(a) Storage Space. Disinfectants, cleaning solutions, poisons, firearms and other items which could pose a danger if readily available to clients shall be stored where inaccessible to clients.This requirement is not met as evidenced by: Based on observation by LPA, there was bleach and laundry detergent on an open shelf next to the clients shared room which poses an immediate health andsafety risk to persons in care.

Maintain separate complete record for each resident

87506(a) Resident Records. The licensee shall ensure that a separate, complete, and current record is maintained for each resident in the facility or in a central administrative location readily available to facility staff and licensing agency staff.This requirement is not met as evidenced by: LPA observed the resident record of the Medication Administration Records (MAR) were not up to date and maintained correctly which poses a potential health ad safety risk to persons in care.

Personal RightsTo be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: Based on observation by LPA, resident R1 was in the converted garage room shared with a staff which poses an immediate health andsafety risk to persons in care.

Regular observation and documentation of resident changes

87466 Observation of the Resident: The licensee shall ensure that residents are regularly observed for changes in physical, mental, emotional, and social functioning and that appropriate assistance is provided when such observation reveals unmet needs. When changes such as ... physical health condition are observed , the licensee shall ensure that such changes are documented and brought to the attention of the resident’s physician and the resident’s responsible party, if any. This requirement is not met as evidenced by: Facility staff admitted to having knowledge of Resident #1’s change of medical condition.

No stage 3 or 4 pressure injuries

Prohibited Health Conditions: Persons who require health services or have a health condition including; but not limited to, those specified below shall not be admitted or retained in a residential care facility for the elderly: Stage 3 and 4 pressure sores (dermal ulcers). This requirement is not met as evidenced by: Upon admission R1 Physician’s Report (8/1/19) documented that R1 had a history of skin breakdown, Stage 3 pressure injury on the right heel/arterial ulcer. On 11/6/19, R1 had 3 unstageable pressure injuries. Staff was aware of R1’s wound condition and retained R1 with a prohibited health condition. R1 expired on 12/04/19.
