(a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights: (16)To written notice of any room changes at least 30 days in advance unless a room change is agreed to by the resident, required to fill a vacant bed, or necessary due to an emergency. This requirement is not met by: Based on the LPA observation, record reviews and interviews the licensee/administrator did not ensure proper notice was given to the resident for room change the above facility which poses a potential Health, Safety or Personal Rights risks to persons in care.

Store centrally held medications in locked secure place

Based on LPA observations, one of two medication carts were unlocked and accessible to residents., which poses an immediate health, safety or personal rights risk to persons in care.

§1569.683 Eviction notices; reasons for eviction contents; service (a)… a licensee of a residential care facility for the elderly who sends a notice of eviction to a resident shall set forth in the notice to quit the reasons relied upon for the eviction, with specific facts to permit determination of the date, place, witnesses, and circumstances concerning those reasons. This requirement is not met as evidenced by. The Licensee did not ensure to provide specific information regarding the steps they should take to prevent resident’s eviction. This poses a potential personal rights violation to residents in care.

Eviction report must be filed within five days

87224 Eviction Procedures (f) A written report of any eviction shall be sent to the licensing agency within five (5) days.This requirement is not met as evidenced by: Based on record reviews, the licensee did not comply with the section cited above as the facility did not send a written report of eviction to the licensing agency within five (05) days which poses a potential health and safety risk and violation of Personal Rights to residents in care.

87219(a)(1-6) Planned Activities-Residents shall be encouraged to maintain and develop their fullest potential for independent living through participation in planned activities. The activities made available shall include: (1) Socialization...(2) Daily living skills/activities...(3) Leisure time activities...(4) Physical activities..(5) Education...(6) Provision for free time...This requirement was not met as evidenced by: Licensee did not provide planned activities to residents in care. LPA interviewed three (03) out of seven (07) residents who revealed that they are bored due to the lack of activities. LPA did not observe any resident engaged in any activity or see an activity calendar posted in the facility which poses a potential health and safety risk to residents in care.

Safe, healthful, comfortable accommodations

87468.1(a)(2)-Personal Rights-Residents in all residential care facilities for the elderly shall have the following personal rights-(2)-to be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment.This requirement was not met as evidenced by: Based on observation, record review, and interviews facility failed to ensure that residents in care are accorded a safe accommodation as seven (07) out of seven (07) residents were left without supervision while staff came in and out of the facility at various times which poses an immediate health and safety risk to 7 out of 7 residents.
