Based on record review and observations, the licensee did not comply with section cited above by not ensuring facility reported R1's prohibited health care condition to licensing department, which poses a potential ealth, safety, and personal rights risk to persons in care.

87411 Personnel Requirements - General (g) Prior to employment or initial presence in the facility, all employees and volunteers subject to a criminal record review shall: (1) Obtain a California clearance... This requirement is not met as evidenced by: Based on observations, interviews and records review, the Licensee did not comply with section cited above by alowing Staff #3 (S3) to work at the facility without criminal background clearance which poses immediate health, safety and personal rights risks to resident in care.

87608 Postural Supports (5) Under no circumstances shall postural supports include tying, depriving, or limiting the use of a resident's hands or feet. (B) Bed rails that extend the entire length of the bed are prohibited except for residents who are currently receiving hospice care... This requirement is not met as evidenced by: Based on observations, interviews and records review, the Licensee did not comply with section cited above by allowing R2 to have full bed rail without Exception Letter approved by CCLD or R2 not on hospice care which poses potential health, safety and personal rights risks to resident in care.

Based on review of R1's record, the licensee did not comply with the section cited above in one (1) out of three (3) residents with beds with full bed rails. This poses an immediate health, safety to persons in care.
