Acceptance obligations tied to pre-admission appraisal needs

A facility need not accept a particular resident for care. However, if a facility chooses to accept a particular resident for care, the facility shall be responsible for meeting the resident's needs as identified in the pre-admission appraisal specified in Section 87457, Pre-Admission Appraisal and providing the other basic services specified below, either directly or through outside resources.This facility was found to be deficient as evidenced by the issuance of (3) eviction notices to a resident, and their responsible family and friends, citing issues with a higher level of care and care needs that were already made aware to this facility upon admission which poses an immediate threat to the Health, Safety, and Personal Rights to residents in care.

Based on observation and interview the licensee did not comply with the section cited. The licensee stated the facility is conduction drills, but the drills are not documented, which poses/posed a potential health, safety or personal rights risk to persons in care.

Ensure hazardous items are locked and not unattended

Based on observation and interview the licensee did not comply with the section cited above. LPAs observed chemicals/detergents accessible to residents in care in bathroom #3, in the passageway outside of the garage exit door, and a hallway linen closet next to bedroom #3. This poses an immediate health, safety or personal rights risk to persons in care.

Passageways and stairways kept clear

Based on observation, interview the licensee did not comply with the section cited above. LPAs observed a trash can and a recycling can obstructing the passageway in the backyard outside of bedroom #1. This passageway is part of the emergency evacuation plan which poses an immediate health, safety or personal rights risk to persons in care.

Financial plan and required reporting obligations

87213 - Finances - The licensee shall have a financial plan that conforms to the requirements of Section 87155... and that assures sufficient resources to meet operating costs for care of residents... This requirement was not met as evidenced by: Based on records review, the facility did not have adequate cash reserves to meet 1 month's average operating costs. This posed a potential threat to the health and safety of residents in care.

87464 BASIC SERVICES. (e) If the resident is an SSI/SSP recipient, then the basic services shall be provided and/or made available at the basic rate at no additional charge to the resident. This requirement was not met as evidenced by: Based on facility records and interview with Administrator, additional charges were imposed on R1 from 12/2020 to 04/2021 for basic services. The rate increase was over the state's NMOHC rate for 2020 and 2021. This posed a potential risk to the health and personal rights of R1.

87468.2 ADDITIONAL PERSONAL RIGHTS OF RESIDENTS IN PRIVATELY OPERATED FACILITIES (12)... to receive written notice of any rate increases according to Health and Safety Code sections 1569.655 and 1569.884. This requirement was not met as evidenced by: Based on facility records, interview with Administrator and R1's representatives, MHHA was not notified of an increase in R1's rent rate. Administrator confirmed MHHA is an additional payor for R1's rent and is therefore a "responsible person" for R1. This posed a potential risk to the personal rights of R1.
