What the inspector wrote

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22) 101230(c) , is being cited on the attached LIC 9099D. Appeal rights were provided, and an exit interview was conducted. The Notice of Site Visit must be posted for 30 days. Director Miller denied the allegations and stated children are not handled in a rough manner to force a child to sit and said staff may have to intervene with children with behavioral issues and do so by gently redirecting them. Director Miller said she ensures any preschool teacher hired has the necessary ECE units to supervise children. Director Miller said S6 was exclusively hired to clean the facility three times a week throughout the day and does a deep cleaning of the facility on weekends. Teachers are required to maintain their own areas clean at all times. Director Miller denied that staff forces children to sleep and said that any child who does not want to sleep is given the opportunity to sit at a table in the nap room with a quiet activity or return to the classroom with children who don’t nap. Director Miller denied that staff is leaving daycare children unattended especially when C5 is taken to the bus stop and said there is additional staff in the classroom supervising children. On 1/4/2023 interviews were conducted with S1–S6 between 12:32pm -2:12pm. Staff denied that children are grabbed and or pulled to force them to sit. S1 and S3 stated staff have the necessary education to supervise daycare children, specifically the required ECE units, and experience, S2, S4, S5, and S6 were uncertain about which staff have the necessary education to supervise children. S1 - S6 stated the facility hired S6 to clean the facility three times a week and deep cleanings are done on weekends. S1-S6 said each teacher is required to keep their own areas clean throughout the day. S1, S3, S5, and S6 denied forcing children to sleep or observing any staff force a child to sleep and stated that any child who does not want to nap is given the opportunity to lie on their cot quietly with a book, sit at a table in the nap room with a quiet activity or return to the classroom with children who don’t nap. S2 and S4 stated they are not in the nap room while the children sleep. S1 – S6 denied staff leaving children unattended specifically when C5 is taken to the bus stop. On 1/4/2023 interviews were conducted with C1–C4 between 10:32am–12:17pm. C1-C4 denied staff grabbing and forcing them onto cots, held down, and forced to sleep. C1-C4 denied being left without adult supervision. On 3/8/2023 interviews were conducted with P1 – P5 between 10:56am–4:55pm. P1-P5 denied having knowledge of their child(ren) or any other child being handled in a rough manner and forced to sit. P1 – P5 admitted to not knowing the teacher-to-child ratios and what the educational requirements are to supervise children. P1 – P5 denied the facility is dirty or that staff force children to sleep. P1, P2, P3, P4, and P6 denied children are being left unattended, specifically when a child is taken to the bus stop located in front of the building. P5 stated multiple staff is present when dropping off and picking up her child. P5 said she is not present at the time a child is taken to the bus stop and is unable to speak about the specific time of day. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. An exit interview was conducted, appeal rights were provided, and a Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

    101230 (c) -A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. This requirement is not met as evidenced by: An interview with S5 who stated she was left alone during naptime with a least 20 children; some children were awake while the others were sleepingg. S5 stated additional staff are not available at the facility to assist.
