The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations:(3) Absence of supervision, including, but not limited to, a child left unattended, and supervision of a child by a person under 18 years of age This requirement was not met as evidence by: Based on interview and video observation, the licensee did not comply with the section cited above which poses an immediate safety or personal rights risk to children in care.

Based on record review, the licensee did not comply with the section cited above in fire drill not completed within the last year which poses an immediate health, safety or personal rights risk to persons in care.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidence by: Staff are allowing children to enter the classrooms unattended which poses a potential health and safety risk to children in care.

PERSONAL RIGHTS

(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidence by: The faciltiy posted pictures and videos of a child without parental consent which poses a potential safety risk to children in care.

ACTIVITIES/NAPPING

101230 (c) -A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. This requirement is not met as evidenced by: An interview with S5 who stated she was left alone during naptime with a least 20 children; some children were awake while the others were sleepingg. S5 stated additional staff are not available at the facility to assist.

Criminal Record Clearance:All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: The facility failing to obtain a criminal record clearance prior to allowing S1 to work at the facility.
