What the inspector wrote

On 8/7/23 LPA E. Laird conducted an interview at the facility with facility administrator Christine McAdams. Christine stated she did know of an incident involving a child's photos being released on social media without parental consent. Christine acknowledged the parent had signed a media release form opting out of having photos of their child posted. On 9/26/23 LPA E. Laird conducted a telephone interview with a parent (P1). P1 stated their child had photos and videos uploaded on several social media sites despite having a media release form on file which specifically stated the child was not to have photos or videos posted. P1 stated there is a current restraining order in place protecting their child and posting pictures and videos places their child in danger. On 10/13/23 LPA E. Laird conducted a telephone interview with Staff 1 (S1). S1 stated they were unaware of any restrictions regarding posting pictures or videos of children in care. S1 stated they did not know about the parental consent forms for media release. S1 stated there was a time when they observed a parent taking pictures of C1 and brought it up to Christine because they felt it was inappropriate for a parent to take photos of another person's child without permission. S1 stated all photos and video taken are uploaded by the facility owner, not by staff. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. A Notice of Site Visit was provided and shall remain posted for 30 days. On 9/21/23 LPA E. Laird conducted a follow-up interview at the facility with facility administrator Christine McAdams. Christine acknowledge a time when a child was left alone in the classroom. Christine stated staff often watch children use the restroom while standing at the entrance between the outside play area and the restroom. Christine stated S1 had notified her of an incident where a child who was using the restroom then went into the classroom to their cubby and the teacher noticed they were gone for an extended amount of time and called the child back. Christine stated the child was unattended in the classroom for that time. Christine later stated the child was not in the restroom, the child was in the classroom and the staff was in the classroom on the other side of the wall. On 10/13/23 LPA E. Laird conducted a telephone interview with S1. S1 stated they did know C1 but they were unaware of an incident where C1 was left alone in the classroom. S1 stated there was not an incident where they told the facility administrator that a child was left alone in the classroom. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted with facility administrator Christine McAdams. The Notice of Site Visit must be posted for 30 days.

This requirement was not met as evidence by: The faciltiy posted pictures and videos of a child without parental consent which poses a potential safety risk to children in care.
