What the inspector wrote

On 04/08/25 at 4:01pm, Licensing Program Analysts (LPAs), Jacqueline Macias and Vicky Williamson conducted an unannounced case management inspection to follow up on a self-reported incident that occurred on 03/28/2025 to the Department. Upon arrival, LPAs met with Facility Representative, Elizabeth Veliz. LPAs disclosed the purpose of the inspection and was granted a tour of the facility. Hours of operation are Monday \342\200\223 Friday 7:30am \342\200\223 5:30pm. There are currently seven (7) classrooms in operation. There were 71 children and 12 staff present during this inspection. On 04/01/25, the facility representative self-reported an incident involving Child 1 (C1) tripping on the turtle shaped sand box on the playground. Staff 1 (S1) stated C1 sustained an injury that required medical attention. Per Facility Representative, the incident occurred on 03/28/25 between 8:30 to 8:45 am. Interviews were conducted with facility representative, staff, authorized representative for C1, and daycare children. LPA inspected the playground and the turtle sandbox. LPA obtained photos of the playground and copies of the facility sign in/out sheets. (S1) stated that C1 approached her and advised her that they fell on the turtle sandbox. S1 stated she was present near the sandbox however did not witness C1 fall. Staff 2 (S2) stated that she stepped away from the playground and was not present during the time of the incident. Per S1, C1\342\200\231s authorized representative was contacted immediately and arrived to the facility shortly after the incident. Per staff and sign in sheets there was two (2) teachers, and twelve (12) children present on the playground during the time of the incident. Based on LPA's observation, daycare children and staff interviews, it was determined that the sandbox is safe and age appropriate. It was determined that there was staff supervision on the playground, therefore this incident is determined to be an accident. No deficiencies cited. A Notice of Site Visit (LIC 9213) was given to facility representative, Elizabeth Veliz and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted and the report was reviewed with Facility Representative, Elizabeth Veliz.

    Based on interview and record review, the licensee did not comply with the section cited above in that 12 staff did not have current mandated reporter training documentation available for review during time of inspection which poses a potential health, safety or personal rights risk to persons in care.
