What the inspector wrote

On 5/8/23 at 9:20am, Licensing Program Analyst (LPA), Martha Malane conducted an unannounced annual inspection and met with Licensee, Alejandrina Ortiz. LPA disclosed the purpose of the inspection and was led on a tour of the facility. There were eight (8) children present. Also present was licensee\342\200\231s husband, David Ortiz and helper, Claudia Jiminez. This single story, 3-bedroom, 1 bathroom home was inspected. The following areas are used for childcare: living room, bathroom, kitchen, back yard, bedroom 1 and day care room. Off limits areas include: bedrooms 2 and 3 which are made inaccessible to day care children through the use of door locks. Facility operates Monday through Friday 6:00am \342\200\223 6:00pm. The fire extinguisher, smoke detector and carbon monoxide detector met requirements. Hazardous items were not made inaccessible to children in care. At 9:25am, LPA observed kitchen knives, chemicals and medication accessible to children in the kitchen, bathroom and backyard. LPA informed licensee that sharp knives, chemicals and medication shall be made inaccessible to children in care; licensee made hazardous items inaccessible to children during the inspection. Licensee stated there are no bodies of water on the premises. Licensee stated there are no firearms or weapons in the home. LPA informed licensee the children shall be supervised during outdoor activities. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Licensee acknowledged understanding of the requirements for criminal record clearances. Licensee\342\200\231s First Aid and CPR certifications expire 8/24. Licensee has required immunization records on file, per file review. Licensee, licensee\342\200\231s husband and helper do not have mandated reporter training certification; see LIC809D for deficiency cited. LPA informed licensee the mandated reporter training shall be completed once every two years. See LIC809C continuation... The last fire/disaster drill was conducted documented 1/1/23. LPA informed licensee the disaster drills shall be completed once every six months and documented. Required documents were posted. A sample of children\342\200\231s files and staff files were reviewed and incomplete; see LIC809D for deficiencies cited. Facility roster was reviewed and complete. Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual \342\200\223 Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. At 9:21am, LPA observed two (2) infants, Child 1 (C1) and Child 2 (C2) sleeping in car seats and one (1) infant sleeping in a play yard with blankets; see LIC809D for Type A deficiency cited. Licensee has not been conducting or documenting 15 minute checks on sleeping infants; see LIC809D for deficiency cited. LPA informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov . LPA discussed and provided Licensee with the following: child care advocates email address: childcareadvocatesprogram@dss.ca.gov. LPA informed licensee in order to sign up for Quarterly Updates and PINs through our website. LPA Martha Malane informed licensee, Alejandrina Ortiz that this report dated 5/8/23 documents three (3) Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA, Martha Malane informed the licensee to provide a copy of this licensing report dated 5/8/23 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted with Licensee, Alejandrina Ortiz. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
