    (a)The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by:interview and record review. Multiple interviews revealed that staff have yelled in an aggressive tone to address children in care and that child #2 caused open bite marks on child #1. These actions are not conducive of safe and healthful accommodations as required. This poses an immediate health, safety and or personal rights risk to the persons in care.

    BUILDINGS AND GROUNDS

    Buildings and Grounds.The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidenced by: observation. During the inspection of restroom #3, it was observed that the floor was dirty and the sink was discolored and yellowing in some areas. This poses a potential risk to the health, safety and or personal rights of children in care.

  • TEACHER-CHILD RATIO

    Teacher – Child Ratio. There shall be a ratio of one teacher supervising no more than 12 children in attendance except as specified in (b) and (c).This requirement was not met as evidenced by: observation and interview. During circle time, there was one teacher (staff 1) supervising 19 children, while 3 other staff were on the other side of the room and could not provide visual observation. Director confirmed this observation today. This poses a potential risk to the health, safety and or personal rights of children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision. (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement was not met as evidenced by: interviews and observation. The lack of supervison made it possible for child #1 to ingest several rocks and be injured with a wood block by another child. This poses an immediate risk to the health, safety and or personal rights of children in care.
