HSC 1597.58(c)(2) Absence of supervision, including, but not limited to, a child left unattended, and a child left alone with a person under 18 years of age. This requirement is not met as evidenced by: Based on interviews conducted by SS and S1, a child was left unattended inside the nap room. This poses an immediate health and safety risk to children in care. A civil penalty of $500 is being issued for absence of supervision.

CHILD'S MEDICAL ASSESSMENTS

Based on record review the facility did not comply with the section cited above. LPA reviewed that three daycare children's files were missing their physician reports and/or not verified by a licensed physician, which poses a potential health, safety or personal rights risk to persons in care.

DISASTER AND MASS CASUALTY PLAN

Based on record review and interview with Site Supervior, the facility did not comply with the section cited above and has not conducted a fire drills/disaster drill at least once with six months, which poses a potential health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

101223(a)(3) Personal Rights: a) The licensee shall ensure that each child is accorded....(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse...This requirement is not met as evidenced by: Based on interviews with Site Supervisor and staff 1, a daycare child was inappropriately grabbed to stand up when siting on the floor, which poses a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212(d)(1)(D)....a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event....Any suspected physical or psychological abuse of any child. This requirement is not met as evidenced by: Based on review and staff interview, a written report was not submited to the department and appropriate agencies within 7 days, which poses a potential health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a)(1) Responsibility for Providing Care and Supervision:The licensee shall provide care and supervision...meet the children's needs....No child(ren) shall be left without the supervision of a teacher at any time...include visual observation. This requirement is not met as evidenced by: Based on LPA's observation and interviews from one staff, two children and one parent, the facility were not properly supervising the children when in the restroom, which poses a potential health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

101223(a)(1) Personal Rights:(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement is not met as evidenced by: Based on interview with staff a verbal altercation between a staff member and daycare parent; resulting in them yelling at each other and making inappropriate comments while children were present, which poses a potential health, safety or personal rights risk to persons in care.
