PERSONAL RIGHTS

9099D: 102423 (a)(2) - Personal Rights: (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged ... These rights include ... : (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement is not met as evidenced by: Based on the Licensee's admission, interviews, and medical records, a dog in the facility bit a child in the check resulting in injury requiring medical treatment. This poses an immediate health and safety risk to children in care. A civil penalty of $2000 is being issued for violation of regulation resulting in a serious injury.

CHILD'S RECORDS

Based on record review, the licensee did not comply with the section cited above in count out of Child 1 and Child 2 missing a proof of Immunization Record/exemption. Also, Child 2 missing the CDPH 286 form and LIC995A Notification of Parents’ Rights which poses/posed a potential health, safety or personal rights risk to persons in care.

102416(c)(b) A licensee of a large family day care home...ensure that at least one person who has a current certificate in pediatric first aid and pediatric cardiopulmonary resuscitation ... be available at all times when children are present at the facility....This requirement was not met as evidenced by: Based on Record Review Licensee’s staff member (S3) did not have a current Pediatric CPR and First Aid Certification when they were alone with day care children, which poses a potential health, safety or personal rights risk to persons in care.

HEALTH AND SAFETY CODE SECTION

1596.885(c) Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this stateThis requirement was not met as evidenced by: Based on Licensee submitted fraudulent documents to receive subsidy program funds by showing inaccurate time in and out entries on monthly records when children were found not to be in attendance, which poses an immediate health and safety risk to the children in care.

PERSONAL RIGHTS

a)Each child receiving services from a family child care home shall have certain rights that shall not be waived...not limited to, the following:(4)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature...This requirement was not met as evidenced by: Based on interviews with L1 and S1 on 06/22/22 and 08/01/22, it was corroborated that on an unspecified date, S1 grabbed child C1 by their ear to get child 1 C1's attention, which poses an immediate Health, Safety or Personal Rights risk to children in care.

INFANT SAFE SLEEP

The provider shall supervise infants while they are sleeping and adhere to the following requirements: The provider shall physically check on the infant every 15 minutes.This requirement is not met as evidenced by: Based on interviews with staff, S1 and S2 on 06/21/2022 and L1 on 08/01/2022, the facility could not furnishing proof that 15 minutes checks had were being conducted and documented for infants. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
