REPORTING REQUIREMENTS

101212(b)Reporting Requirements (b) The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). This requirement is not met as evidence by: Based on observations and interviews, interim director was not reported to the the department for the 5 months that the director was not present, which poses a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

101238(a) Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement is not met as evidence by: Based on observations,facility is in unsafe and in need of repair, which poses a potential health, safety or personal rights risk to persons in care.

California Lead Action Level at Child Care Centers

California Lead Action Level at Child Care Centers. A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement is not met as evidenced by: Lead water testing samples taken on 11/03/2022 revealed that levels of lead were beyond the allowable amount deemed by the State of California. This is a type B violation which poses a potential Health, Safety or Personal Rights risk to persons in care.

PERSONAL RIGHTS

101223(a)(3)(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Based on LPA interviews with staff who told a child in care, in front of other children, that if he did not behave, the bugs would come back. Which poses a Personal Rights risks to children in care.

101238(a)(1)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.(1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement is not met as evidenced by: Based on LPA interviews with staff and children, who disclosed that there was an ongoing pest/cockroach issue, which poses immediate Health and Safety risks to children in care.

101216(l) Personnel Requirements (l) All personnel shall be informed of their rights pursuant to Sections 1596.881 and 1596.882 of the Health and Safety Code. Based on records review. LPA reviewed 07 files they are incompleted. Which poses a potential Health or Safety, or personal rights risk to persons in care.
