During the course of investigation, LPA reviewed 4 staff files and 5 children’s files, obtained a Children’s Roster, LPA also interviewed 4 staff members, 2 children and 3 parents. During the staff interviews, staff #1 (S1) stated the facility is a clean and safe environment for children. S1 said the other day a parent went through an off-limit area and there are items in the hallway but now there is child safety gate to prevent entrance into the off-limit area. S1 does not have any concerns that the home is too cluttered because it’s in the off-limit areas and in the childcare it’s not cluttered, it’s Montessori based so there is a section for the concepts, it requires a lot of stuff. Staff #2 (S2) stated the facility is clean and safe environment for children, except the construction area in the backyard. No one is allowed back there right now. S2 denied having concerns for the most part, and that the facility is not too cluttered for the children in care. S2 stated the assistants clean the daycare areas daily and the two licensees clean the off-limit areas not as often, not daily. S2 thinks the home is clean and free of clutter. Staff 3 (S3) stated the home is a clean and safe environment for children but also stated the home is a little bit cluttered. S3 stated, S1, S4 and S3 clean the facility and they clean it every day. S3 denied that the home is too cluttered. When asked if S3 thinks the facility is clean, tidy, and free of clutter S3 stated, “yes, the daycare areas.” S3 disclosed concern for an off-limit area, S3 pointed to living/dining room area and items, “I’m scared of this area but we always grab their (children’s hands) when walking through this area”. Staff #4 (S4) stated the home is a clean and safe environment for children and denied that it’s too cluttered. The facility is cleaned every day by S1, S3 and S4. When asked if there were any areas of concern in regard to too much clutter or cleanliness, S4 stated the living room and dining room. The daycare areas are clean, tidy and free of clutter. LPA Valdez Santana contacted 6 parents for an interview and was able to interview 3 parents. 1 of 3 parents, stated concerns over the amount of clutter in the home. It’s a business also so it should not have so much clutter everywhere. Child #1 (C1) stated the facility is clean. When asked if there are too many things/items in the home, C1 said, “yes, her house is messy”. Child #2 (C2) stated the licensee “has too much stuff”. While conducting the investigation, LPA conducted a thorough inspection of the daycare areas including off-limit areas. LPA took various pictures of the facility showing clutter in areas that although are off-limit areas, children still have access to and have to walk through in order to access daycare areas. Based on LPA’s observations, interviews conducted, it was determined that Licensee does not ensure that the home is clean, sanitary, or free from clutter. The preponderance of evidence standard has been met; therefore the above allegation s is found to be SUBSTANTIATED . California Code of Regulations, Title 22, Division 12, Chapter 1 Section 102417(b) Operation of a Family Child Care Home: Type B is being cited on the attached LIC 9099D. This is a repeat violation. Civil Penalty was assessed. Please refer to attached 9099D for documentation of deficiencies. Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained.
