C1 and S2 disclosed the home is messy and there is too much stuff. One out 3 parents stated concerns over the amount of clutter in the home.

This poses a potential risk to children in care.

Operation of a Family Child Care Home: (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by: Based on LPA’s interviews, staff #1, Staff #2, and Staff #3 disclosed that S1 has been out of the country off and on since October of 2023 until present. Licensee is out of the facility more that than 20% of the time.

This requirement is not met as evidenced by: Based on LPA’s interviews, staff #1, Staff #2, and Staff #3 disclosed that staff deny parents/authorized representatives inside access to the daycare facility. Child #1 also stated C1’s parent comes to the door and the teacher comes out and brings C1 inside.

102417 Operation of a Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times.This requirement is not met evidenced by: Both interviewed adults, A1 and A3 admitted that no adult was paying attention to C1 and 2 other children who were playing in the playhouse on the backyard on 08/22/2023, which posed an immediate risk to the health, safety and personal rights of the children in care.

PERSONNEL RECORDS

102416.1(d) Personnel Records- All personnel records shall be maintained at the child care home and shall be available to the licensing agency for review.This requirement is met as evidence by: Based on LPA’s interviews, S2 stated A1 watched at least one child before S2’s shift began. Licensee no longer had a file for Adult #1 (A1) and Adult #2 (A2)- volunteer/substitute.

STAFFING RATIO AND CAPACITY

(d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home,including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either:(1) Twelve children, no more than four of whom may be infants; or (2) More than twelve and up to fourteen children only if the criteria in Section 1597.465 of the Health and Safety Code are met.This requirement is not met as evidenced by:Based on observation, and interview, at 12:30pm, LPA Valdez Santana took census of the children present, observed 4 infants & 6 preschool & 4 school age children in the childcare facility.

ARTICLE 2. Administration of Child Day Care Licensing

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by:Based on [(observation) (record review)], the licensee did not comply with the section cited above. Licenseeand staff did not have a current mandated reporter certification available for review which poses/posed a potential health, safety or personal rights risk to persons in care.

INFANT SAFE SLEEP

Based on observation, interview, record review, during file at 11:30am LPA Odom observed 1 infant under 12 months, LPA reviewed child#6 file and LIC 9227 Individual Infant plan was missing. The licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

IMMUNIZATIONS

Based on(observation, interview, and record review, during file reviews at 11:30am, 2 out of 12 children were missing immunization records. The licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

STAFFING RATIO AND CAPACITY

Based on observation, and interview, at 9:55am, LPA Odom took census of the children present and observed 5 infants in the childcare facility, 1 infant napping and 4 infants playing in the backyard. Licensee stated, parent of Child#12 informed licensee the night before they would drop off C12 at the childcare facility for 2 hours. Parent picked up C12 at 10:35am from the childcare facility. The licensee did not comply with the section cited above in which poses an immediate health, safety or personal rights risk to persons in care.
