101217 Personnel Records (d) All personnel records shall be maintained at the child care center and shall be available to the licensing agency for review. This requirement is not met as evidenced by: During LPA’s initial complaint visit on 08/20/25, LPA reviewed sample of staff records and files and observed 3 out of 3 staff sample files did not have the required documentation for LPA to review.

1596.955 Child day care centers serving preschool age children; optional program; departmental guidelines and regulations (a) The department shall develop guidelines and procedures...program component for children between 18 months to three years of age. This optional toddler program shall be subject to the following basic conditions: (3) A ratio of six children to each teacher is maintained for all children in attendance at the toddler program...this requirement is not met as evidenced by: on 08/20/25, during LPA’s initial complaint visit, LPA observed a census of 14 children and 2 staff in the Early Preschool Classroom. However, a child enrolled in the Toddler Option program was included in the ratio that day, and a ratio of six children to each teacher should be maintained for all children in attendance at the toddler option program.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by: Multiple witness statements that staff do not ensure children’s hygiene needs are met while toileting in that potty training children are solely responsible for wiping themselves without staff supervision or assistance. This constitutes a potential health, safety, and/or personal rights risk to children in care.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

(a) Drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area.(1) Children shall be free to drink as they wish. This requirement was not met as evidenced by: Multiple witness statements that staff do not ensure children have water in their bottles or that the outside water jug is filled with potable water so bottles can be refilled outside as needed. This constitutes a potential health, safety, and/or personal rights risk to children in care.

(5) The following shall be offered daily:(B) Full-day programs shall ensure that each child has a lunch. (1) The child's authorized representative may send meals and/or snacks for the child. This requirement was not met as evidenced by: Documentation review and interviews stating that outside food is not permitted in the center. This is a potential health and safety risk to children in care.

In child care centers providing meals to children, the following shall apply:(7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. This requirement was not met as evidenced by: Documentation review and interviews stating that a child was denied a modified diet with a doctor’s note. This is a potential health and safety risk to children in care.
