PERSONNEL REQUIREMENTS

Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the review of staff files the LPA was unable to review an LIC 503 Health Screening for S1.

ARTICLE 1. General Provisions and Definitions

Based on the record review, the Licensee did not meet the above regulation which poses a potential health risk to the children in care. During the review of staff files the LPA was unable to review current immunizations for S2 and S4.

REPORTING REQUIREMENTS

Based on the observation/interview/record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. Upon arriving to the facility the LPA was greeted by the kitchen staff who stated the Director was not present. When the Director arrived she stated she left in December 2024 and is only substituting this week, however, the Department has not been notified of the Director change.

OUTDOOR ACTIVITY SPACE

Based on observation , the licensee did not comply with the section cited above, outdoor play equipment had some cracks and rough edges, which poses a potential health, safety risk to persons in care.

OUTDOOR ACTIVITY SPACE

The surface of the outdoor activity space shall be maintained: (2)Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.This requirement was not met as evidenced by: Based on dangerous debris found on the children's playground that children found while playing. This poses a potential health, safety risk to children in care.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the DepartmentThis requirement was not met as evidenced by: Based on LPA's review of facility associations, The Licensee/Director did not get a clearance prior to Staff #1 working with preschool children. This poses an immediate health, safety, and personal rights risk to children in care.

California Lead Action Level at Child Care Centers

California Lead Action Level at Child Care Centers 101700.3 (b)(1): A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance.This requirement is not met as evidence by: Based on records review of required lead testing, the facility had lead values of 5.5 ppb or above on water outlets: B (15) & D (6,1).This is a potential health and safety risk to persons in care.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

Based on observation, the licensee did not comply with the section cited above in 1 out of 1 changing table has sharp edges where children's head is positioned which poses/posed a potential health, safety or personal rights risk to persons in care.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

Based on observation the licensee did not comply with the section cited above in that the red/yellow play structure has unsafe swings and an unsafe elevated walking area. which poses/posed a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

Based on observation, the licensee did not comply with the section cited above in 2 out of 2 floor panel/ transition strips that are missing in one bathroom and broken in the other bathroom in Room C which poses/posed a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

Reporting Requirements...Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department (1) Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by...Both the Director and the Assistant Director confirmed they did not report the incident of a child being left unattended on 06/03/22.This is a potential risk to Health, Safety & Personal Rights to the children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Providing Care and Supervision...No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement was not met as evidenced by... LPA Zeron observed a written statement in staff members file regarding a child being left unattended in the classroom on 06/03/2022. This is an immediate risk to Health, Safety & Personal Rights to the children in care.

LIMITATIONS ON CAPACITY

Limitations on Capacity and Ambulatory Status. The licensee shall not exceed the conditions, limitations and capacity specified in the license. This requirement was not met as evidenced by: LPA observed school age children commingle with the pre school program children. Two school age program children were allowed to move freely between both programs. This conduct poses a potential risk to the health and safety of children in care.

Teacher-Child Ratio - There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by: Complaint investigation revealed that in the mornings from 7:00am - 8:00 am there is one teacher present and up to 15 children at one time. This conduct poses a potential risk to the health and safety of children in care.
