What the inspector wrote

On date and time listed, Licensing Program Analysts (LPAs) Kim Leung and E;yse Jones arrived at the facility to conduct an annual inspection. LPAs toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: Normal days and hours of operation are: Monday through Friday, 8am to 5pm OFF-LIMIT AREAS INCLUDE: Laundry room, master bedroom and the bedroom next to the hall bathroom. The laundry room and the bedroom next to the hall bathroom are accessible to children. The facility is operating within the licensed capacity and appropriate ratios during inspection. However, records revealed that the facility was operating out of ratio this current month on November 1, 8, 9, 10, 16 and 17. \302\267 Appropriate supervision was provided during this inspection \302\267 A working telephone is present and a current number on file \302\267 Appropriate fire extinguisher, smoke detector and carbon monoxide detector present and were tested by the Licensee during this inspection. \302\267 No fireplace \302\267 Hazardous items stored in the kitchen, laundry room and the bedroom next to the hall bathroom are accessible to children \302\267 No weapons as stated by assistant Dalinda Ramos. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations \302\267 Single Story Home \302\267 Verification of control of property on file (home owner) \302\267 License, Facility Sketch, Emergency Disaster Plan & Notification of Parent\342\200\231s Rights poster are posted \302\267 Mandated Reporter Training expired on 8/19/2020 \302\267 Only online CPR and Standard First Aid Card completed \302\267 Health & Safety Certificate - completed on 8/26/2016 \302\267 No bodies of water at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Clean, safe and age appropriate toys \302\267 Current roster on file \302\267 Documentation of fire and disaster drills on file \342\200\223 Last drill conducted in February 2019 \302\267 Children\342\200\231s records are complete \302\267 Employee\342\200\231s records are not complete \302\267 The Licensee was informed of their reporting requirements and is provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov \302\267 Resident and/or staff records reviewed on 11/19/2021 indicate that all adults who require caregiver background checks have received all required clearances or exemptions. \302\267 The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov - LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm - Facility representative Dalinda Ramos was reminded that all adults residents 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Family Child Care Home. Civil penalties of one hundred dollars ($100) per violation per day for a maximum of five (5) days may be assessed by the Department. Subsequent violations within a twelve (12) month period will result in a civil penalty of one hundred dollars ($100) per violation per day for a maximum of thirty (30) days. - Go to the licensing webpage www.ccld.ca.gov , and click on the \342\200\234Receive Important Updates\342\200\235 located on the right side of the page, immediately above the Quick Links. One can add their email address and choose which program(s) they wish to receive Provider Information Notices (PIN) for. - The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 1-844-LET-US-NO (1-844-538-8766) and/or 951-782-4200 See LIC809-D for cited deficiencies. The assistant provider Dalinda Ramos confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.   • STAFFING RATIO AND CAPACITY

    Based on interview and record review, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. Facility was operating out of ratio on November 1, 8, 9, 10, 16 and 17 with more than 12 children and up to 14 children attending at the same time and all of the children are younger than 5 and none of them is enrolled in kindergarten or transitional kindergarten yet as stated by assistant provider Dalinda Ramos.

  • Family Day Care Homes

    Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. Immunization records for Staff 2 and Staff 3 are not available for review during inspection. Assistant provider Dalinda Ramos stated that no other records are available for review at the time.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. As stated by assistant provider Dalinda Ramos, licensee admitted to not renewing the training after the training expired on 8/19/2020. Staff 2, 3 and 5 who are present during inspection have not completed the training.

    Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. LPAs observed 4 assistant providers supervising children during the inspection. However, there are no LIC508 Criminal Record Statement available for review during inspection. Assistant provider Dalinda Ramos stated that no other records are available for review at the time. During inspection, Staff 1 completed the LIC508.

    Based on observation and interview with the provider, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. The garage was off limits as stated at the prelicensing inspection by the licensee. However, LPAs observed children napping the garage during inspection. LPAs observed that the garage is set up as a child care room with tables, chairs, child care furniture and toys there. Assistant Dalinda Ramos stated that children nap and eat in the garage which is a violation of the fire clearance.

  • OPERATION OF A FAMILY CHILD CARE HOME

    Based on observation, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. Hazards including prescription medications, over-the-counter medications, supplements stored in kitchen, laundry solutions stored in laundry room, toothpaste and deodorant stored in the bedroom adjacent to the hall bathroom are accessible to children. Whipped cream with label "Could be fatal" stored in refrigerator in kitchen is accessible to children.

  • OPERATION OF A FAMILY CHILD CARE HOME

    Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. Per drill log, last drill was conducted in February 2019. No other drill log for review as stated by assistant provider Dalinda Ramos.
